European legal regulation of artificial intelligence and its application

Abstract:

Tato diplomová práce hodnotí dopad návrhu nařízení EU o regulaci umělé inteligence (akt o umělé inteligenci) do české legislativy i aplikační praxe a také porovnává právní regulaci v EU, USA a Číně. Metodami práce jsou analýza a komparace právních norem a analýza veřejných dokumentů i odborných článků. Výsledkem práce je zjištění, že nařízení necílí na aktuální teoreticko-právní otázky aplikace umělé inteligence, ale na prevenci potenciálních rizik této rapidně se rozvíjející technologie. Česká legislativa podobnou úpravu neobsahuje, a proto nařízení nepřinese zásadní nutnost přizpůsobit české normy.

Abstract:

This diploma thesis evaluates the impact of the proposal for the EU regulation of artificial intelligence (Artificial Intelligence Act) in the Czech legislation and application practice, and also compares legal regulation in the EU, USA and China. Main methods of the thesis are analysis and comparison of legal norms and analysis of public documents and scientific articles. The result of the work is the finding that the EU regulation does not aim at current theoretical and legal issues of the application of artificial intelligence but at prevention of possible future risks of this rapidly developing technology. The Czech legislation does not contain similar provisions, and therefore the regulation will not bring a fundamental necessity to adapt the Czech law.
