The Common Criminal Policy of the EU as the spillover effect: the Perspectives of "communitarization" of the Third Pillar

Anotace:

Cílem této práce je přiblížit společnou trestní politiku Evropské unie pohledem neofunkcionalistické integrační teorie s důrazem na neofunkcionalistický proces spillover. Úvodní kapitoly této práce obsahují základní definice potřebné pro další zkoumání a stručný popis neofunkcionalistické teorie Ernsta B. Haase. Zahrnuty jsou taktéž výklady o možném vztahu neofunkcionalistické teorie a práva. Následující kapitoly popisují nejdůležitější instituty společné trestní politiky a její vývoj od počátků trestní spolupráce v sedmdesátých letech až po současnost. Následuje přiblížení postojů klíčových politických aktérů v aréně třetího pilíře, přičemž důraz je kladen zejména na Evropský soudní dvůr, ústavní soudy členských států, Komisi, Radu a vlády členských států. Závěrečné kapitoly pak analyzují možnosti komunitarizace materie třetího pilíře a roli práva a neofunkcionalistické teorie v současném integračním procesu.

Abstract:

The aim of this thesis is to examine the Common Criminal Policy of the EU in the view of neofunctionalist theory of the European integration with emphasis on „the spillover effect“. The initial chapters of this thesis provide basic definitions necessary for further research and brief insight into the neofunctionalist theory of Ernst B. Haas. Possible links between neofunctionalist theory and the role of law in the integration process are included. The following chapters include description of the Common Criminal Policy of the EU from the beginning in the 70s to current days. The next chapters examine approaches of the main political actors in the political arena of the Third Pillar, like The European Court of Justice, national constitutional courts, European Commission, European Council and governments of the member states. Last chapters analyze possibilities of the "communitarization" of the Third Pillar and role of law and neofunctionalist theory in the contemporary integration process of the Third Pillar.
