Forced heir and his disinheritance

Abstract:

Diplomová práce se zabývá problematikou jednoho ze základních institutů dědického práva a to nepominutelného dědice a jeho vydědění. Je zde rozebrán historický vývoj tohoto institutu společně se základními pojmy, které se k dané problematice pojí. Tato práce obsahuje komparaci předcházející právní úpravy (zejména zákona č. 40/1964 Sb., občanský zákoník) s platnou právní úpravou zákona č. 89/2012 Sb., občanský zákoník, který přinesl mnoho zásadních změn v oblasti dědického práva. Hlavní část této práce se zaměřuje na změny v postavení nepominutelného dědice, zákonné důvody vydědění a práva na povinný díl.

Abstract:

This thesis deals with the issue of one of the basic institutes of inheritance law, namely the indispensable heir and their inheritance. The historical development of this institute is discussed here, together with the basic concepts associated with the issue. This thesis contains a comparison of previous legislation (especially Act No. 40/1964 Coll., Civil Code) with the current legislation of Act No. 89/2012 Coll., Civil Code, which brought many fundamental changes in the field of inheritance law. The main part of this thesis focuses on changes in the status of the indispensable heir, the legal grounds for disinheritance and the right to a compulsory share.
