Criminality of public agents focused on corruption

Abstract:

Tato bakalářská práce se zabývá definováním trestných činů, kterých se může dopustit veřejný činitel. Vymezení osoby jako veřejného činitele je základní otázkou, kdy je v tomto postavení, za jakých podmínek a při které činnosti. Téma je zaměřené na korupci ve veřejné správě z pohledu celosvětového problému a blížeji pak na stav korupce v České republice. Pojednává tuto problematiku především z hlediska trestněprávního s vymezením nejčastějších oblastí jejího výskytu s ohledem na možné pachatele. Dokument se zmiňuje také o protikorupčních opatřeních vybraných států ve srovnání s mezinárodními požadavky a hodnotí některé z nich ve vztahu k právní úpravě naší republiky a navrhované rekodifikaci trestního zákona. Samostatným obsahem jsou uvedené smlouvy a dohody organizací, které se zabývají bojem proti korupci v rozsahu celosvětového významu nebo v působnosti Evropské unie. Do textu byly také pro názornost zpracovány příklady jednání veřejných činitelů, které mají znaky korupční trestné činnosti.

Abstract:

This assignment is to define different types of crime commited by public agents. The definition of a public agent is a basic questions and an understanding under which conditions and activities one is in this position is crucial. The topic of the assignment is a corruption in the public sector from the international perspective and it is followed by the description of the situation in the Czech Republic. The problem is discussed especially from the criminal poin of view and the most frequent areas are specified with respect to the possible offenders. The document also deals with anti-corruption arrangements of selected countries and compares them to the international requirements and evaluates some of them in relation to the Czech legal regulations and proposed re-codification of the penal code. A special section contains contracts and agreements of organizations describing fight against the corruption both world-wide and in the competency of European Union. For the clearness in the text there is included few examples of public authorities‘ behaviour having signs of corruption crime.
