Abstract:

Bakalářská práce pojednává o uplatňování trestněprávního principu „ultima ratio“ v praktickém postupu Policie ČR. Analyzuje základní zásady trestního práva úzce spojené s meritem věci, kdy převážně klade důraz na zásadu subsidiarity trestní represe a zásadu oportunity. Samozřejmostí je také náhled do historie trestního práva na našem území (ČR) a to od konce první světové války do současnosti. V práci jsou dále vytyčeny některé základní pojmy trestního práva. Práce obsahuje exkurz do zahraničních trestněprávních a trestně procesních úprav vzhledem k tématu práce a praktický náhled na uplatňování principu „ultima ratio“ Policií ČR. Závěr práce uvádí úvahy nad současnou interpretací a aplikací principu „ultima ratio“ de lege lata a úvahy de lege ferenda.

Abstract:

Bachelor’s thesis discusses exercise of criminal principle of “ultima ratio” by the Police of Czech Republic. Thesis analyses basic principles of criminal law closely related to merits of a case and focuses mainly on the principle of subsidiarity of criminal punishment and principle of opportunity. Thesis further briefly explores history of criminal law in the area of Czech Republic starting at the end of the First World War up to present. Basic principles and concept of criminal law are also outlined. Thesis touches foreign legislation of criminal and penal law regarding the analysed topic and the way the principle of “ultima ratio” is exercised by the Police of Czech Republic. Conclusion reflects upon today’s interpretations and exercise of principle of “ultima ratio” de lege lata (according to existing positive law) and de lege ferenda (according to intended law).
