Movement of Goods under the External Transit Procedure

Abstract:

Tato diplomová práce je zaměřena na problematiku vnějšího tranzitu zboží, v jehož rámci je přepravováno zboží pod celním dohledem, jeho jednotlivé formy a řešení v případě nedodržení podmínek tohoto celního režimu. Nejdříve jsou vymezeny teoretické otázky související s problematikou tranzitu, jeho členění a právní úpravy na mezinárodní, unijní a národní úrovni. Následně je provedeno systémové rozčlenění tranzitu v Evropské unii na základě právních předpisů upravující celní právo, popsány jednotlivé tranzitní systémy a jejich podmínky, za kterých lze vnější tranzit realizovat. V závěru se práce zabývá otázkami nedodržení podmínek vnějšího tranzitu a s tím souvisejícího vzniku celního dluhu a následků vzniklých z takového protiprávního jednání.

Abstract:

This dissertation is focused on issues of the external transit of goods, within the frame of which goods are transported under the customs supervision. It also deals with the particular types of the external transit and with solution possibilities in the case, if these customs procedure conditions are not observed. First, the work specifies theoretical questions connected with transit issues, its structure and juridical regulations on the international level, on the national level as well as on the EU level. The following part presents the system classification of the EU transit based on juridical regulations and rules governing the customs law. The particular transit systems are described here as well as the conditions under which the external transit can be performed. The final part of this work deals with issues connected with violation of the external transit conditions, with the customs debt origination related with such violation as well as with impacts resulting from such lawless behaviour.
