Abstract:

Cílem práce "Propuštění zaměstnance pro jeho nadbytečnost" je podat čtenáři ucelený a srozumitelný výklad o výpovědi dané zaměstnavatelem z důvodu nadbytečnosti zaměstnance. Práce je rozdělena na šest částí včetně úvodu a závěru. Ve druhé kapitole se práce zabývá vysvětlením základních pracovněprávních pojmů. Podrobně je zde popsán pracovní poměr, dále jsou vysvětleny pojmy jako "zaměstnanec" a "zaměstnavatel", "dohody o pracích konaných mimo pracovní poměr" a "zkušební doba". Třetí kapitola pojednává obecně o skončení pracovního poměru a přibližuje čtenáři všechny způsoby, kterými lze skončit pracovní poměr dle zákoniku práce. Čtvrtá kapitola se věnuje konkrétní formě skončení pracovního poměru - výpovědi z pracovního poměru. V této kapitole je zároveň nastíněna problematika hromadného propouštění a odstupného. Pátá kapitola je stěžejní kapitolou této práce. Tato kapitola pojednává o nadbytečnosti zaměstnance. Nadbytečnost je zde rozebrána jednak z pohledu zákoníku práce, především však z pohledu judikatury Nejvyššího soudu.

Abstract:

The aim of the thesis "Termination of labour contract for employee redundancy" is to give the reader a comprehensive and comprehensible explanation of the dismissal given by the employer due to the employee's redundancy. The thesis is divided into six parts including the introduction and the conclusion. In the second chapter the thesis deals with the explanation of basic labor-law terms. The terms of employment are described in detail, and terms such as "employee" and "employer", "off-employment agreements" and "trial period" are explained. The third chapter deals with the termination of employment in general and explains to the reader all the possibilities in which the employment can be terminated according to the Labor Code. The fourth chapter deals with the specific form of termination of employment - notice of employment. At the same time, the issue of mass layoffs and severance pay is outlined in this chapter. The fifth chapter is the central chapter of this thesis. This chapter discusses employee redundancy. Redundancy is here discussed from the perspective of the Labor Code, especially from the perspective of the Supreme Court case law.
