The General Substitution in Law of Succession

Abstract:

Diplomová práce pojednává o úpravě obecné dědické substituce. Hlavním cílem je seznámit se s tímto institutem a vymezit jeho pozici v právním prostředí. Práce je v první půli zaměřena na analýzu dědické substituce jako celku a blíže charakterizuje jednotlivé její formy. V druhé půli je popsán historický vývoj dědické substituce. Důraz je při tom kladen na úpravu obecné substituce. Za účelem porovnání jednotlivých forem dědické substituce a jejich úprav ve stěžejních kodexech je hojně využívána metoda komparace.

Abstract:

This thesis deals with treatment of the General Substitution in Law of Succession. The main objective is to get acquaited with the institute and define its position in the legal environment. Thesis is in the first half oriented on the analysis of inheritance substitution as a whole and characterizes its various forms in detail. In the second half of the thesis is describe the historical development of inheritance substitution. Emphasis has been placed on the treatment of general substitution. In order to compare the various forms of inheritance substitutions and adjustments in key codes is widely used method of comparison.
