Procedural Role and Task of Insolvency Administrator in Insolvency Proceedings

Abstract:

Tato diplomová práce se zabývá osobou insolvenčního správce, jeho rolí a procesním postavení v rámci insolvenčního řízení, jeho odpovědnostmi a pravomocemi. Cílem práce je analýza jen vybraných aspektů práce správce, přičemž se snaží nalézt odpověď na otázku, jestli je současná česká právní úprava procesního postavení insolvenčního správce úpravou dostatečnou a moderní a dále se také snaží nalézt řešení případných nedostatků. Po krátkém historickém exkursu je provedena teoretická analýza insolvenčního řízení a dále je teoreticky analyzována role insolvenčního správce a jeho postavení v řízení. Některé teorie jsou přizpůsobeny problematice insolvence a insolvenčního správce. Ve speciální části je dále analyzována osoba insolvenčního správce, stejně jako různé „zvláštní“ druhy insolvenčních správců, kvalifikační a profesní požadavky, nebo odměňování insolvenčních správců. Je také proveden rozbor procesní role insolvenčního správce podle současné právní úpravy a tam, kde je to vhodné, je provedena komparace s vybraným zahraničním právním řádem. Závěrem diplomant konstatuje, že současná právní úprava postavení insolvenčního správce nepochybně přináší mnoho pozitivních ustanovení, které jsou v souladu s legislativou „insolvenčně“ vyspělých zemí. Na druhou stranu zejména požadavky na kvalifikaci insolvenčních správců, jejich odměňování a také činnosti v rámci některých způsobů řešení úpadku vyžadují dle názoru autora této práce legislativní změnu tak, aby lépe vyjadřovaly náročnost činnosti insolvenčních správců a jejich procesní postavení a úlohu v insolvenčním řízení.

Abstract:

The aim of this diploma thesis is to find an answer to the question whether the current regulation of the insolvency administrator's procedural status is modern enough to be compared to insolvency law of foreign countries. The author does not aim to analyze the regulation as a whole but rather focus on specific issues. The author deals with particular questions e.g. professional qualification requirements, the amount of remuneration and the procedural activity of insolvency administrators. The general part focuses on the historical and theoretical base while the special chapter discusses the abovementioned points in light of the current Czech legislation - the author discusses not only individual types of the insolvency administrators but also variety of proceedings. Further part of the thesis focuses on the upcoming law changes implementing the potentiality of claim denial in favor of the creditors. Overall the Czech regulation is in accordance with the law of "insolvency developed” countries. On the other hand, certain issues e.g. the professional qualification requirements, the amount of remuneration and the procedural activity of insolvency administrators, call for the legislative change to make the insolvency law more flexible and business-accurate.
