Sale Contract (in mode of Czech Commercial Code and CISG)
Abstract:
Aim of this diploma work is to compare CISG and regulation of sale contract in Czech Commercial Code. It focuses on definition of the term „goods“, character of both sources, interpretation, contracting, performance of obligation and liability for breach of parties’ duties. Short final chapter is attended to issues of CISG application in Canada.
Abstract:
Cieľom tejto práce je porovnať Dohovor OSN o zmluvách o medzinárodnej kúpe tovaru s úpravou kúpnej zmluvy v obchodnom zákonníku ČR. Sústreďuje sa na vymedzenie pojmu tovar, charakter oboch prameňov, otázky interpretácie, kontraktácie, splnenia zmluvy a zodpovednosti strán za porušenie svojich povinností. V krátkej záverečnej kapitole sa práca venuje problematike aplikácie Dohovoru v Kanade.
