Cílem této práce je osvětlit systém používání alternativního trestání ve smyslu probace a mediace, poukázat na jeho výhody a naznačit jak tento systém reaguje na vzrůstající míru kriminality. Práce je zaměřená na hledání problémů v tomto systému, které mohou mít vliv na využívání mediace a probace, včetně mých vlastních návrhů na zlepšení jejich fungování.
