Return of the Principle "Superficies Solo cedit" in the Czech Private Law

Abstract:

Diplomová práce se zabývá aktuálním tématem, a to návratem zásady superficies solo cedit do právního řádu České republiky. Vychází nejdříve z vysvětlení podstaty uvedené právní zásady, z historického vývoje této zásady a jejího uplatnění v právních předpisech platících na území našeho státu. Za účelem vysvětlení podstaty právní zásady se práce dále zabývá obecnými právními pojmy souvisejícími s právní zásadou superficies solo cedit, zejména v kontextu k nové právní úpravě v zákoně č. 89/2012 Sb., občanského zákoníku. Diplomová práce dále vysvětluje nový právní institut bezprostředně související se zásadou superficies solo cedit, tj. právo stavby. Těžiště diplomové práce je však v rozboru, zhodnocení a i v kritice přechodných ustanovení nového občanského zákoníku, kterými dochází k zavedení právní zásady superficies solo cedit do našeho právního řádu. V neposlední řadě práce řeší i promítnutí nově zavedené zásady superficies solo cedit do právních předpisů o katastru nemovitosti.

Abstract:

This thesis deals with a current topic of a return of the superficies solo cedit principle to the legal system of the Czech Republic. Firstly, it is based on the explanation of the nature of this legal principle, secondly, on the historical development of the principles and lastly, on its application applied in the Czech law. In order to explain the nature of legal principle the work also deals with general legal concepts related to the superficies solo cedit principle, especially in the context of the new arrangements in Act No. 89/2012 Coll ., The Civil Code. The thesis also explains the new legal institution directly related to the superficies solo cedit principle, i.e. the right of the build. However, the thesis is focused on the analysis, evaluation and even criticism of the transitional provisions of the new Civil Code, which leads to the introduction of the superficies solo cedit principle into our legal system. Finally, the work addresses the projection of the newly re-established principle superficies solo cedit into law about the land register.
