Exigency as a Factor Excluding Turpitude

Abstract:

Institut krajní nouze, který je tématem této práce, je zahrnut do oblasti trestního práva a pojmově vymezen v platném trestním zákoníku. Účelem jeho využití je v podstatě vyloučení protiprávnosti, tedy odpovědnosti za skutek, který by jinak byl trestným činem, případně ve správním právu přestupkem. Práce proto vymezuje samozřejmě nejen pojem krajní nouze, ale i podmínky, za kterých může být aplikována všemi orgány činnými v trestním řízení. Právě těmto přísluší posouzení toho, zda situace, která je řešena, odpovídá definici krajní nouze dle zákona. Část práce je věnována i konkrétním případům, které byly rozhodovány soudy a zejména judikovány nejvyššími soudy. V jejím závěru jsou rovněž uvedeny kapitoly týkající se vyloučení odpovědnosti nejenom ve správním právu, ale i v právu občanském a pracovním, kde vyloučení protiprávnosti jednání má za následek vyloučení odpovědnosti za vzniklou škodu.

Abstract:

The institute of necessity which is the topic of this thesis belongs to the field of criminal law and is conceptually determined in the valid Criminal Code. The purpose of its use is basically the exclusion of illegality, i.e. the liability for an act that would otherwise be a criminal act or in administrative law an infraction. Hence the thesis determines not only the concept of necessity but also the conditions under which it can be applied by all investigative, prosecuting and adjudicating bodies. These are the ones that have the right to consider if a situation that is being solved corresponds with the definition of necessity according to the law. A part of the thesis deals also with particular cases that have been decided by courts and especially judicially decided by supreme courts. In the end there are also chapters related to the exclusion of liability not only in administrative law but also in civil and employment law where the exclusion of act illegality results in the exclusion of liability for damage.
