Comparative constitutionalism of Middle East Countries

Abstract:

Předkládaná bakalářská práce se zabývá komparací ústav několika blízkovýchodních zemí, jmenovitě Íránu, Saúdské Arábie a Libanonu. Motivací pro vznik této práce byl autorův vlastní zájem po poznání nejen reálného, ale i právního (normativního) základu blízkovýchodních vlád, protože spatřuje svou budoucí kariéru v práci na poli mezinárodního práva se vztahem ke zmíněnému regoinu. Důvod výběru tří konkrétních zemí byl v pokrytí hlavních charakteristických znaků a v ukázání rozdílných typů vlád - první je teokratickou republikou, druhá absolutistickou monarchií a poslední je relativně standardní demokratickou republikou. V této práci je slovní spojení Blízký východ používáno v širším smyslu, jak to např. uvádí Encyclopaedia Britannica, tedy zahrnující území od Severní Afriky přes Záliv až po Afghánistán. Společným činitelem většiny zahrnutých zemí (samozřejmě kromě Izraele) je vliv dominantního náboženství, Islámu. Tato víra důrazně spojuje doktrínu s politikou a tím vytváří zvláštní klima pro výkon státních mocí - legislativy, exekutivy i judikativy. Úvodem je předložena oddělená studie každého státu a jeho ústavy. Začíná krátkým přehledem, následovaným analýzou reálné ústavy, tedy jak je země ve skutečnosti organizovaná a kdo disponuje faktickým vlivem. Každá moc je popsána ve zvláštní kapitole a jsou naznačeny body styku. Vedle obecných informací je čtenář upozorněn také na zvláštnosti každého zřízení, například čtvrtá (duchovní) moc v Íránu nebo spolupráce místo rozdělení mocí v Saúdské Arábii. Následně jsou předloženy ústavní texty se zmínkami o jejich pozadí, okolnostmi přijetí, struktuře a vnitřní jednotnosti. Je naznačena korelace mezi skutečným stavem a ústavními normami. Na závěr je každá země konfrontována se stavem lidských práv, zejména politickými svobodami a volebním právem. Vlastní komparace se nejlépe uskuteční z několika hledisek. První bylo vybráno hledisko hisotrické, které zahrnuje ústavní tradice, možné zdroje inspirace a okolnosti přijetí. Druhé bylo zkoumáno hledisko jazykové. Třetí hledisko, na které se zaostřilo, byla lidská práva. Zdálo se správné, vyhnout se tradičním klišé, jako například status ženy v islámské společnosti, ale zkoumat a analyzovat celkovou situaci, hlavně stupeň politické svobody. Čtvrté hledisko obsahovalo pohled na vztah mezi ústavou a mezinárodním společenstvím, zvláště otázky mezinárodních smluv. Poslední hledisko zahrnuje vnitrostátní kontext - od čeho se odvíjí legitimita režimu, jak se ustavuje hlava státu, jaké mají politici imunity nebo jak se ústava novelizuje. Převládající trojjazyčnost regionu je v práci respektována. Z důvodu referenční funkce této práce se autor snažil vytyčit návaznost na cizojazyčnou literaturu, zejména skrze odkazy na používanou právní a politickou terminologii v příslušných jazycích. Každý, kdo se zajímá o problematiku hlouběji, tak může obdržet široký základ. Závěr práce není jednoznačný. V žádném případě není její smysl v odsouzení kteréhokoli systému vlády a už vůbec ne z euro-atlantického pohledu. Naopak, práce si klade za cíl posloužit jako úvodní seznámení se zmíněnou ústavně-politickou a geografickou oblastí.

Abstract:

The presented thesis deals with comparison of constitutions of several Middle East countries, namely Iran, Saudi Arabia and Lebanon. Motivation for the work to emerge was the author’s own interest to discover not only real, but also legal (normative) background of Middle East governments, because he sees his future career working in the field of International Law preferably toward the aforementioned region. The reason for choosing the three respective countries was so as to cover the majority of distinguishing signs and to present different government prototypes - the first being theocratic republic, the second an absolute monarchy and the final one a relatively standard democratic republic. In this work the term Middle East is used in the larger sense as suggests e.g. the Encyclopaedia Britannica, covering the area from North Africa through the Gulf up to Afghanistan. The common point of the majority of included countries (except Israel, of course) is influence by the dominant religion of Islam. This faith highly connects its doctrine with politics and thus creates an unique climate for all powers; legislative, executive as well as judicative, to operate. Firstly, a separate study of each country and its constitution is offered. It begins with a short introduction, followed by an analysis of the actual constitution, that is how the government is organized in real life or who holds the effective power. In their respective chapters, all three powers are described and links between them are drawn. In addition to point out general facts there are also particular ones to be mentioned such as cooperation instead of division of powers in Saudi Arabia or a fourth (clerical) power in Iran. Then constitutional statutes are presented. Their background, circumstances and means of adoption, structure and internal consistency is shown. Connections between the real behavior and the constitution norms are indicated. Finally, each country is concluded with human rights observations, namely political freedoms and suffrage issues. The main comparison is best done from several different views. Firstly, historical view was chosen, which includes constitutional traditions, possible sources of inspiration and circumstances of origin. Secondly, the lexical view is examined. Thirdly, the human rights situation is the focus. It seems proper to avoid cliches by over-emphasizing the status of women in Islam society for example, but to try to analyze the overall situation, namely the degree of political freedom. Fourthly, it is useful to see the constitutional link to the international community with respect to treaties or other influences. Finally, but not least, it is interesting to compare their internal impacts - what legitimacy of regime is derived from, how the head of state is established, what immunity top politicians have or how the constitution is amended. The prevailing trilinguality in the given region is respected. For referential purpose of this work, the author tried to keep the connection to foreign literature, namely by indicating relevant technical terms in the respective languages, so that anyone interested in obtaining more information has a solid base to start from. The result of the thesis is not explicit. This work was by no means considered as a condemnation of any nation’s system of government and certainly not one that is viewed merely through an Euro-Atlantic persective. Instead, it should serve as an introduction to the mentioned area of interest.
