Abuse of Dominant Position and Use of Economic Approach in Competition Law

Abstract:

The subject of this diploma thesis titled "Abuse of dominant position and use of economic approach in competition law" , is to introduce and analyse the economical approach in competition law. It has changed and radically modernised in the last period of years. In the first chapters there is a focus of the way of changes. The next chapters belong to comparation of two basic documents and guidlines of the European Commission (Discussion Paper and Guidance). The end goes to efficiencies, which are very important in the appraisal of abuse of the dominant position.

Abstract:

Predmetom predloženej diplomovej práce s názvom "Zneužitie dominantného postavenia a použitie ekonomických hľadísk v súťažnom práve" je predstaviť a analyzovať vývoj ekonomického prístupu k súťažnému právu, ktorý sa v posledných rokoch zmenil a radikálne zmodernizoval. Prvé kapitoly sú zamerané na priebeh zmien. ďalšie patria porovnaniu dvoch základných metodických pokynov Európskej Komisie (Discussion Paper a Guidance), a na záver autor zhodnotil prínos tzv. efficiencies, ktoré sú veľmi doležité pri posudzovaní zneužitia dominantného postavenia.
