Remuneration of persons employed in imprisonment in the Czech Republic with an emphasis on the repayment of their debts in 2018-2020

Abstract:

Diplomová práce se zabývá problematikou zaměstnávání a odměňování pracujících odsouzených k trestu odnětí svobody v souvislosti s umořováním jejich dluhů. Teoretická část popisuje fungování českého vězeňství a poukazuje na záležitosti dopadající na státní rozpočet. V praktické části práce jsou uvedena zjištěná pozitiva a negativa zaměstnávání vězňů a návrhy opatření, které by stav mohly zlepšit. Dále jsou představeny a vyhodnoceny změny ve výši odměny za práci a srážek z čisté odměny. Na konci práce je proveden kvalitativní anonymní výzkum, ve kterém je detailně posuzována mzdová situace pěti konkrétních odsouzených žen, které vykonávají trest v Drahonicích, věznici spadající pod Věznici Nové Sedlo. Výsledky analýzy a srovnání potvrzují, že modifikace legislativního nastavení odměňování podporuje splácení pohledávek odsouzených osob. Zároveň bylo ale zjištěno, že velikost dluhů je na tak vysoké úrovni, že během výkonu trestu je z nich umořeno velmi malé procento.

Abstract:

The diploma thesis deals with the issue of employment and remuneration of working sentenced to imprisonment in connection with the repayment of their debts. The theoretical part describes the functioning of the Czech prison system and points to issues affecting the state budget. The practical part of the thesis presents the identified positives and negatives of employment of prisoners and proposals for measures that could improve the situation. Furthermore, changes in the amount of remuneration for work and deductions from net remuneration are presented and evaluated. At the end of the work, a qualitative anonymous research is carried out, in which the wage situation of five specific convicted women serving a sentence in Drahonice, a prison under the Nové Sedlo Prison, is assessed in detail. The results of the analysis and comparison confirm that the modification of the legislative setting of remuneration supports the repayment of receivables of convicted persons. At the same time, however, it was found that the size of the debts is at such a high level that a very small percentage of them is repaid during the execution of the sentence.
