Judicial Review of Public Administation

Abstract:

Diplomová práce se zabývá problematikou podstaty soudní kontroly veřejné správy, která je svěřena v největší míře soudům správním, ale také soudům civilním a soudu Ústavnímu. Práce se dále zaměřuje především na podrobný výklad žaloby proti rozhodnutí správního orgánu ve světle platné právní úpravy, přičemž je kladen důraz na rozhodovací praxi soudů. Nedílnou součástí práce je také analýza vybraných změn, které přinesla tzv. velká novela soudního řádu správního, a jejich následné zhodnocení na základě statistických dat.

Abstract:

This thesis deals with the nature of judicial review of public administration, which is entrusted to the greatest extent possible the administrative courts, but also the civil courts and the Constitutional Court. The work also focuses on the detailed interpretation of an action against an administrative decision in the light of current legislation, with the emphasis on decision-making practice courts. An integral part of the thesis is an analysis of selected changes brought about by the so-called Large amendment of the Administrative Procedure, and their subsequent evaluation based on statistical data.
