Abstract:

Tato kvalifikační práce se zabývá problematikou whistleblowingu a ochrany oznamovatelů. Cílem práce je zjistit současný stav whistleblowingu v České republice, přičemž tento cíl je rozdělen na několik dílčích cílů, které jsou zkoumány v jednotlivých kapitolách. První kapitola seznamuje čtenáře s teoretickým pozadím whistleblowingu, definuje tento pojem, představuje osobu oznamovatele a nabízí rozlišení mezi interním a externím whistleblowingem. Druhá kapitola se zaměřuje na Směrnici Evropského parlamentu a Rady EU ze dne 23. října 2019 o ochraně osob, které oznamují porušení práva Unie, a analyzuje její transpozici do českého právního rámce v podobě zákona č. 171/2023 Sb., o ochraně oznamovatelů, ve znění pozdějších předpisů. Ve třetí kapitole dochází k analýze britské právní úpravy o ochraně oznamovatelů, známé jako The UK Public Interest Disclosure Act 1998, která figuruje v této práci jako metoda tzv. best practice. Ve čtvrté kapitole jsou následně právní úpravy České republiky a Velké Británie porovnány. Poslední kapitola této práce představuje dotazníkové šetření, jehož cílem bylo zmapovat povědomí zaměstnanců obchodních společností v České republice o problematice whistleblowingu a nově přijatém zákoně o ochraně oznamovatelů.

Abstract:

The aim of the Master thesis is to determine the current state of whistleblowing in the Czech Republic. This aim is divided into several sub-goals, which are examined in individual chapters. The first chapter introduces the theoretical background of whistleblowing, defines the concept and the figure of a whistleblower, and offers a distinction between internal and external whistleblowing. The second chapter focuses on the Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law and analyses its transposition into the Czech legal framework in the form of Act No. 171/2023 Coll., on the protection of whistleblowers. The third chapter analyses the whistleblowing legislation in the UK, known as The UK Public Interest Disclosure Act 1998, which is referred to in this thesis as the best practice method. Subsequently, the legal regulations of the Czech Republic and the United Kingdom are compared in a comparative analysis. The final chapter of this thesis presents a questionnaire survey, aimed at mapping the awareness among employees of business companies in the Czech Republic regarding the issue of whistleblowing and the newly adopted Whistleblower Protection Act.
