Corruption and the international fight against corruption – a case study of South Korea

Abstract:

Abstrakt Jedním z největších problémů moderní doby je korupce, a to navzdory dlouholetému boji proti ní. Tématem této práce je korupce a protikorupční opatření přijatá Jižní Koreou. Cílem práce je zhodnotit efektivní metody a opatření, která Jižní Korea zavádí k prevenci korupce a zjistit inspirativní význam pro mezinárodní společenství. Otázky, na které práce hledá odpověď jsou: Jaká kombinace efektivních protikorupčních opatření umožnila Jižní Koreji snížit míru korupce? Jaká opatření vlády země měla příznivý vliv na zvýšení indexu vnímání korupce? Do jaké míry jsou tato protikorupční opatření inspirativní k uplatnění pro mezinárodní společenství? Práce používá popisnou a historickou metodu při řešení výzkumného úkolu studie historické kořeny korupce v Koreji a při zkoumání protikorupčních kampaní prezidentů. Další použitou metodou je případová studie týkající se politického a legislativního vývoje Jižní Koreje, která zhodnotí účinnost opatření přijatých k boji proti korupci. Práce se skládá z úvodu, čtyř kapitol, závěru a seznamu zdrojů. V první kapitole se práce zaměřuje na pojem a druhy korupce. Jsou uvedeny různé definice korupce jako mnoho složitého a multidisciplinárního fenoménu veřejného života, stejně jako mezinárodní právní rámec spolupráce v boji proti korupci. Druhá kapitola se zabývá historickým kořenem korupce v Jižní Koreji a protikorupčními reformami prezidentů Kim Young-sama a Kim Dae-junga. Třetí kapitola analyzuje vývoj hlavní protikorupční infrastruktury, jako jsou protikorupční legislativa a agentury pro boj s korupcí. Čtvrtá kapitola zvažuje zkušenosti Jižní Koreje s korupcí s doporučením implementace pro mezinárodní společenství. Závěr práce hodnotí studii a uvádí řadu doporučení pro další země. Program „OPEN” v oblasti e-governmentu a Komise pro boj proti korupci a pro občanská práva (ACRC) jsou klíčovými body úspěchu v boji proti korupci v Jižní Koreji.

Abstract:

Abstract One of the biggest problems of modern times is corruption, despite many years of fighting. The topic of this work is corruption and anti-corruption measures taken by South Korea. The aim of this work is to evaluate the effective methods and measures which South Korea has implemented to prevent corruption and find out their inspiring significance for the international community. The questions the work seeks to answer are: What combination of effective anti-corruption measures has enabled South Korea to reduce corruption? Which government measures have had a positive effect on increasing the corruption perception index? To what extent are these anti-corruption measures inspiring for the international community? The thesis uses a descriptive and historical method in solving the research task of studying the historical roots of corruption in Korea and in examining the anti-corruption campaigns of presidents. Another method used is a case study on South Korea's political and legislative developments, which will assess the effectiveness of measures taken to combat corruption. The work consists of an introduction, four chapters, a conclusion, and a list of sources. The first chapter focuses on the concept and types of corruption. Various definitions of corruption are given as many complex and multidisciplinary public life phenomena, as well as an international legal framework for cooperation in the fight against corruption. The second chapter deals with the historical root of corruption in South Korea and the anti-corruption reforms of Presidents Kim Young-sam and Kim Dae-jung. The third chapter analyses the development of major anti-corruption infrastructure, such as anti-corruption legislation and anti-corruption agencies. The fourth chapter considers South Korea’s experience with corruption with implementation recommendations for the international community. The conclusion evaluates the study and makes a number of recommendations for other countries. The e-Government “OPEN” program and the Anti-Corruption and Civil Rights Commission (ACRC) are key success points in the fight against corruption in South Korea.
