The Public Defender of Rights and Protection from Discrimination

Abstract:

Tématem bakalářské práce je Veřejný ochránce práv a ochrana proti diskriminaci. Hlavní cíl práce je statické shrnutí činnosti Veřejného ochránce práv v oblasti ochrany proti diskriminaci a zhodnocení na kolik je konzistentní s českými soudy. Práce je rozčleněna do čtyř částí. První část je věnována historii instituce ombudsmana a jeho postupnému rozšiřování po světě. Dále v této části je popsán vývoj Veřejného ochránce práv, jakožto i jeho definice, postavení vůči složkám státní moci a působnost. Druhá část práce se zaměřuje na vysvětlení pojmů diskriminace a právo na rovné zacházení, spolu s tím jsou uvedeny možnosti, jak se proti diskriminaci bránit. Třetí část práce se zaměřuje na jednotlivé kompetence Veřejného ochránce práv, kterými disponuje v antidiskriminačních věcech. Čtvrtá část práce se zabývá konzistentností Veřejného ochránce práv s českými soudy a konkrétními případy z oblasti diskriminace, které Veřejný ochránce práv řešil.

Abstract:

The topic of the bachelor thesis is the Public Defender of Rights and protection against discrimination. The main aim of the thesis is to provide a static summary of the activities of the Ombudsman in the field of protection against discrimination and to assess how consistent it is with the Czech courts. The thesis is divided into four parts. The first part is devoted to the history of the ombudsman institution and its gradual expansion around the world. Furthermore, this part describes the development of the Ombudsman, as well as its definition, position in relation to the branches of state power and its scope. The second part of the thesis focuses on the explanation of the concepts of discrimination and the right to equal treatment, along with the possibilities of defending oneself against discrimination. The third part of the thesis focuses on the individual competences of the Ombudsman in anti-discrimination cases. The fourth part of the thesis deals with the consistency of the Public Defender of Rights with the Czech courts and specific discrimination cases that the Public Defender of Rights has dealt with.
