Tax Control - the Right of the State to Collect Taxes X Protection of the Taxpayers Ownership

Abstract:

The goal of the thesis is to confirm or disapprove the main hypothesis, which states that the current application and interpretation of laws regarding tax audits reflects the proportionality principle with respect of the state’s right to collect tax versus the basic right of the tax subject to own and use their property. A further goal of the thesis is to confirm or disapprove the connecting hypothesis, stating that the burden of proof is balanced between the tax administrator and the tax subject – the tax subject has adequate tools to protect their rights and the tax administrator has sufficient tools for completing their fiscal functions. In this respect, attention will be paid to application of tax audit, tax procedural principles, rules of proving and using the tools of proofs, focusing on the problematic areas of proving in the tax process. The substantive part of the thesis is aimed at the analysis of the current judicial decisions and their practical impacts on the tax subject during the tax audit. I have used the comparative, descriptive, deductive and analytical methods. The thesis is based on legal status as of 28 February 2020.

Abstract:

Cieľom diplomovej práce je potvrdenie alebo vyvrátenie hlavnej hypotézy, že súčasná aplikácia a interpretácia právnych noriem daňovej kontroly odzrkadľuje princíp proporcionality práva štátu na výber dane voči základnému právu daňového subjektu vlastniť a užívať majetok. Cieľom bude takisto potvrdiť alebo vyvrátiť nadväzujúcu hypotézu, že dôkazné bremeno správcu dane a daňového subjektu počas daňovej kontroly je vyvážené - daňový subjekt má adekvátne prostriedky na obranu svojich práv a správca dane dostatočné nástroje na plnenie svojich fiškálnych funkcií. Pozornosť bude zameraná na aplikáciu inštitútu daňovej kontroly, zásad daňového konania, pravidlá dokazovania a použitia dôkazných prostriedkov s poukázaním na problematické oblasti dokazovania v daňovom konaní. Podstatná časť diplomovej práce bude venovaná analýze súčasnej judikatúry a jej faktickému dopadu na daňové subjekty pri výkone daňovej kontroly. Pre spracovanie diplomovej práci som použila metódu komparácie, deskripcie, dedukcie a analytickú metódu. Práca vychádza z právneho stavu k 28.2.2020.
