Dispositional Procedural Acts of Parties in Court of First Instance

Abstract:

Diplomová práce se zabývá problematikou dispozičních procesních úkonů stran před soudem I. stupně v civilním sporném řízení. Po komplexním výkladu o dispoziční zásadě a obecném vymezení dispozičních procesních úkonů přechází práce k analýze jednotlivých úkonů této skupiny. Právní úprava jednotlivých úkonů je analyzována z hlediska historického a mezinárodního a zjištěné závěry jsou komparovány s obsahem věcného záměru civilního řádu soudního. V závěru práce je souhrnně zhodnocena míra naplnění dispoziční zásady skrze současnou úpravu a dále je zhodnocen postoj úpravy zamýšlené.

Abstract:

The thesis deals with the issue of dispositive procedural acts of the parties before the court of first instance in civil litigation. After a comprehensive interpretation of the dispositive principle and a general definition of dispositive procedural acts, the thesis proceeds to an analysis of individual acts of this group. The legal regulation of individual acts is analysed from the historical and international perspective and the findings are compared with the content of the substantive intent of the Civil Procedure Code. The thesis concludes with a summary assessment of the degree of fulfilment of the dispositive principle through the current regulation and an assessment of the position of the intended regulation.
