Detaining a culprit efore and after joinig the CR the Schengen executive convention

Abstract:

Práce pojednává o změnách v trestním řádu ČR, týkajících se zadržení pachatele, které nastaly s přistupováním ČR do evropských struktur. V úvodu je v souvislosti s ukončením kontrol na vnitřních hranicích vstupem do schengenského prostoru zpracována statistika nelegální migrace. Následuje historický vývoj institutu zadržení a vybrané ukázky z judikatury Ústavního soudu a Evropského soudu pro lidská práva. Dále je v práci nastíněna spolupráce zemí ES a EU v trestních věcech a vliv Schengenské prováděcí úmluvy a zavedení evropského zatýkacího rozkazu na změnu zadržení v trestním řádu. V závěru je uveden výhled změn spolupráce v EU a institutu zadržení.

Abstract:

The thesis deals with the changes in the Rules of Criminal Procedure of the Czech Republic, regarding the offender detention, which arose by entering of the Czech Republic into European structures. In the introduction, the statistics of illegal migration is elaborated in connection with the end of inner border controls after entering the Schengen area. This is followed by historical development of the institute of detention and by selected chapters of judiciary of the Constitutional Court and the European Court of Human Rights. Furthermore, the cooperation of ES and EU countries in criminal matters, the effect of Schengen Agreement and the implementation of European warrant of arrest on the modification of detention in the Rules of Criminal Procedure are outlined in the thesis. In the conclusion, the perspective of changes in cooperation in EU and the institute of detention are mentioned.
