Sales Promotion Events and Protection of Particularly Vulnerable Groups of Consumers

Abstract:

Předmětem této práce jsou předváděcí akce zaměřené na seniory jako zvláště ohroženou skupinu spotřebitelů. Senioři pod vlivem agresivních a klamavých praktik uzavírají smlouvy, jež by za jiných okolností nepodepsali. Práce se věnuje jak veřejnoprávním, tak i soukromoprávním aspektům předváděcích akcí. Jádrem práce je rozbor konkrétních nekalých praktik užívaných na předváděcích akcích a analýza praktických problémů spojených s uplatňováním právních prostředků ochrany vůči jejich pořadatelům. Česká právní úprava je srovnávána s německým přístupem k problematice předváděcích akcí. V závěru práce jsou navrhována řešení problému s nekalými praktikami předváděcích akcí.

Abstract:

This diploma thesis deals with sales promotion events, that are focusing on elderly people as a group of particularly vulnerable consumers. The elderly conclude a contract under the influence of aggressive and misleading practices, which they would not do in other circumstances. This thesis elaborates on aspects of sales promotion events from the public law point of view, as well as from the private law point of view. The core of this thesis lies in an analysis of specific unfair practices, that are frequently used on sales promotion events and in an analysis of practical problems associated with enforcement of the law in regard with them. Czech approach to the issue of sales promotion events is compared to the german legislation. In the conclusion, there are suggestions of possible solutions of the problem with „unfair“ sales promotion events.
