Court's Duty to Instruct

Abstract:

Diplomová práce se zabývá poučovací povinností soudů tak, jak je dána ustanovením § 5 zákona č. 99/1963 Sb., občanského soudního řádu,ve srovnání s úpravou poučovací povinnosti dle německého (§139) a rakouského (§ 182) civilního soudního řádu (die Zivilprozessordnung). V rámci kapitoly o materiálním vedení řízení se práce věnuje také dotazovací a vysvětlovací povinnosti soudu, v části týkající se poučovací povinnosti samotné je kladen důraz na její normativní zakotvení a obsah a limity zohledňující princip rovnosti stran a zásadu předvídatelnosti. Poslední část práce se týká zvláštní poučovací povinnosti dle § 118a odst. 2 zákona č. 99/1963 Sb. (die Überraschungsentscheidungen)a tzv. manudukační povinnosti soudu (die Manuduktionspflicht).

Abstract:

This thesis focuses on the court´s duty to instruct according to the section 5 Act No. 99/1963 Sb., code of civil procedure, and analyses it in comparison with the legal form of the court´s duty to instruct as is known in the German (section 139) and Austrian (section 182) codes of civil procedure. First part of the thesis related to the material conduction of proceedings focuses on the interrogatory and explanatory duty; second part referring to the duty to instruct emphasizes and explores its normative basis, as well as the contents and limits with respect to the principles of equality of the parties and predictability of the proceedings. The last part of the thesis analyses the court´s duty to instruct according to the section 118a (2) Act No. 99/1963 Sb. surprise decisions) and court´s duty to instruct that is aimed at the unrepresented parties.
