Procedural Legitimation in Civil Contentious Proceedings

Abstract:

Tato rigorózní práce se zabývá problematikou procesní legitimace, která úzce souvisí s institutem věcné legitimace, institut procesní legitimace totiž umožňuje vyhovět žalobě i v situaci, kdy v řízení nevystupuje hmotněprávně oprávněný či hmotněprávně povinný, což by za normální situace vedlo k zamítnutí žaloby pro nedostatek věcné legitimace. V první části se autor se zabývá otázkou formálního vymezení účastenství, věcnou legi-timací a nezbytností existence procesní legitimace pro tuzemský civilní proces. Dále autor po-pisuje současný stav české nauky, srovnává tuzemskou koncepci procesní legitimace s německou koncepcí procesního postavení a snaží se procesní legitimaci doktrinálně vymezit. Autor se dále zabývá problematickými oblastmi s procesní legitimací souvisejícími, zejména otázkou přípustnosti, otázkou pramenů procení legitimace, otázkou překážky litispendence a otázkou účinků soudního rozhodnutí na skutečného nositele subjektivního hmotného práva či hmotněprávní povinnosti. V další části se potom autor zabývá některými vybranými případy, v nichž by se podle tuzemské či zahraniční právní úpravy mohlo jednat o procesní legitimaci. Jedná se například o postavení správce majetku v soudním řízení, jakož i o určovací žaloby třetích osob či o pod-dlužnickou žalobu. Na závěr jsou shrnuty výsledky práce a je navržena úprava de lege ferenda.

Abstract:

This thesis is concerned with procedural legitimation, which relates closely to a right to litigate; procedural legitimation allows the court to uphold an action even if it is instituted by a person different from the one, which holds the right or incurs the liability in question accord-ing to the substantive law. This should normally lead to dismissal of the action because of lack of the right to litigate. In the first part, the author deals with the question of the formal definition of the par-ties, with the right to litigate and with the necessity of the existence of procedural legitimation for the domestic civil procedure. Further on, the author describes the current state of Czech jurisprudence, compares the domestic conception of procedural legitimation with the German conception of procedural status and tries to define procedural legitimation. Subsequently, the author deals with some problem areas, that are related to procedural legitimation, especially the question of permissibility, the question of the sources of procedural legitimation, the ques-tion of lis pendens and the question of the effects of the court’s decision on the rightholder or on the liable person. In the next part, the author focuses on several selected cases, which could be according to domestic or foreign legislation described as samples of procedural legitimation. These in-clude for example the status of trustees in the civil proceedings, the declaratory actions of third persons or the third-party-debtor proceedings. In the concluding section, the results of the thesis are summarized and proposals are made for modification of the relevant legislation.
