Protectorate of Bohemia and Moravia from Historical and Legal Perspective

Abstract:

This Bachelor's thesis concerns the period of the Protectorate of Bohemia and Moravia, which means the occupation of the Czechoslovak state of the time by the German Reich. During the writing of this topic, I dealt with the historical circumstances, not only concerning the reasons for the establishment of this territorial unit, but also concerning its state-political structure and the regulation of public life that, after the Second World War, had a fundamental influence on the formation of legal thinking and the international protection of human rights. First, I focus my attention on the issue of the rise of National Socialism in Germany, up to its expansion into Czechoslovakia through the Munich Agreement. Afterwards, the explanation concentrates on the question of the legal establishment and functioning of the Protectorate of Bohemia and Moravia, especially in connection with the adoption and application of racist legislation. The last two chapters look at the extinction of the Protectorate of Bohemia and Moravia, legal discontinuity, the crisis of legal positivism and the post-war protection of human rights.

Abstract:

Tato bakalářská práce se týká období Protektorátu Čechy a Morava, tedy obsazení tehdejšího československého státu Německou říší. V rámci jejího zpracování se zabývám v kontextu historických okolností nejen důvody vzniku daného územního celku, ale také jeho státně-politickým uspořádáním a regulací veřejného života, což mělo po druhé světové válce zásadní vliv na utváření právního myšlení a mezinárodní ochrany lidských práv. Nejprve věnuji pozornost problematice vzestupu národního socialismu v Německu, a to až do doby jeho expanze na československé území prostřednictvím Mnichovské dohody. Následně je výklad zaměřen na otázku právního vzniku a fungování Protektorátu Čechy a Morava, a to zejména v souvislosti s přijetím a aplikací rasistického zákonodárství. V posledních dvou kapitolách je pak pojednáno o zániku Protektorátu Čechy a Morava, právní diskontinuitě, krizi právního pozitivismu a poválečné ochraně lidských práv.
