Social Harmness as Material Aspect of a crime

Abstract:

Bakalářská práce Společenská škodlivost jako materiální znak trestného činu pojednává o významu a uplatnění pojmu společenská škodlivost v současném formálním pojetí trestného činu, jak bylo zavedeno zákonem č. 40/2009 Sb., trestní zákon. Jádrem práce je hodnocení úlohy společenské škodlivosti jako konstitutivního znaku trestného činu a jako korektivu při samotném trestání. Cílem práce je zhodnotit, zda současné pojetí společenské škodlivosti koresponduje úloze trestního práva ve společnosti.

Abstract:

The Bachelor Thesis “Social Harmful Effects as a Material Aspect of a Crime“ deals with the meaning and the application of the term of „social harmful effects“ in a current formal conception of the crime as it was implemented by the law No. 40/2009 Sb., criminal code. The purpose of this work is to evaluate the social harmful effects considering the fundamental aspect of a crime and the correction of a person during his punishment. The thesis is aimed at consideration the fact whether the conception of a social harmful effects corresponds with the purpose of the criminal law in a society.
