The Justification as Part of The Administrative Decision

Abstract:

V mé bakalářské práci, se zabývám problematikou individuálních správních aktů z hlediska požadavků na jejich odůvodnění. Cílem této práce je zabývat se odůvodněním v jeho širších souvislostech, a to nejen principy dobré správy, ale zaměřit se především na jeho strukturu a požadavky na jeho kvalitu, v neposlední řadě pak také analyzovat vztah výroku a odůvodnění. Práce se zabývá častými vadami odůvodnění a jejich následky. Zaměřím se i na problematická místa právní úpravy a pokusím se nabídnout možná řešení.

Abstract:

In my bachelor thesis, I focused on issues of individual administrative acts with respect to demands for their justification. The goal of the thesis is to look into the topic of justification from a wide context, what means to analyze principles of good administration, as well as its structure and quality requirements, and also to analyze relations between statement and justification. The thesis monitor often repeated mistakes in justification and their consequences. I focus also on problematic parts of legal adjustment and I tried to offer possible solutions.
