Permissible risk in the Penal Code

Abstract:

Institut přípustného rizika jsem postupně rozebrala a zaujala stanovisko k určitým společensky prospěšným činnostem. Jednou z nich je přípustné riziko ve sportu. V rámci hodnocení přípustného rizika ve sportovní činnosti jsem dospěla k závěru, že pod institut přípustného rizika by měla být zahrnuta mimo jiné méně závažná nedbalostní jednání, případně i úmyslná ublížení na zdraví, která ovšem nevybočují z mezí, které jsou považovány za přípustné v rámci daného sportovního odvětví. Není zájem společnosti kriminalizovat jednání společensky akceptovatelné, čímž bezesporu sport je. Soudní judikatura bude muset nastavit hranice, které budou sloužit jak k ochraně jednotlivých sportovců, tak k právní jistotě a předvídatelnosti právních zásahů do sportovní činnosti. Dalším rizikem, kterým jsem se zabývala, je riziko ve zdravotnictví. Zde se střetává zájem společnosti na ochraně zdraví a života jednotlivce, kdy společnost poškození výše uvedených hodnot v souvislosti s poskytnutím zdravotní péče na jedné straně trestá a na straně druhé si uvědomuje prospěšnost lékařského povolání, které si žádá výjimečný přístup. Řešení tohoto střetu podlé mého názoru spočívá ve volbě mezi jednotlivými druhy právní odpovědnosti (zejména odpovědnost pracovněprávní, občanskoprávní). Výše uvedenou problematiku jsem rozebírala i s ohledem na ustálenou soudní judikaturu v této oblasti, přičemž v práci jsem se zabývala průlomovými judikáty. Porovnávala jsem právní úpravu přípustného rizika ve Slovenské a České republice. Přestože stavba, situování a vzájemný poměr okolností vylučujících protiprávnost naznačují, že tyto trestní zákoník řadí mezi základní otázky trestního práva, teoretické zpracování problematiky přípustného rizika, jakožto nově kodifikované okolnosti vylučující trestní odpovědnost, je v nápadném nepoměru k ostatním okolnostem vylučujícím trestní odpovědnost, jež jsou v trestních normách známé z dřívější právní úpravy. Celkovým pojetím tématu jsem naplnila cíl, který jsem si na začátku práce vytyčila, a to vytvoření logicky uspořádaného a uceleného textu, který bude analyzovat přípustné riziko.Posláním institutu přípustného rizika je vyloučení nástupu trestně právní sankce za takové jednání, které je společensky prospěšné, nicméně vedlejším efektem jeho realizace je možný vznik společensky nežádoucích následků.

Abstract:

Risk is an undetachable part of human life. It is connected with virtually every action a human being takes ? from mere getting up in the morning, through getting to any place by mass transport, over taking part in any economic activity to taking part in other general activities of his or her own life. Without risk there would be no scientific, social or economic motion, no progress and no life as we know it. As risk plays such an important role in human lives, it is desirable to keep it under control. Taking unnecessary risks should be forbidden, while at the same time, manners that are risky, dangerous and could be an acquisition for the society should be supported and protected. Law should also reflect this occasion ? and this is the origin of the concept of ?permissible risk?. This criminal tool protects behaviour that is intended to be beneficial for the society, despite it brings some kind of socially detrimental effect. For long time permissible risk has been a concept that has existed extra-legal by Czech penal codes and statutes. It has been a theoretical concept introduced to practice via the concept of social danger. Now, as the new Czech Penal Code 40/2009 Sb. leaves the concept of social danger behind, there arises a need for a more precision definition of all the conditions of permissible risk. That is the reason why permissible risk has been incorporated into the general part of the Czech Penal Code 40/2009 Sb. as its § 31. The § 31 constitutes following conditions, under which an act cannot be qualified as and punished for permissible risk: the acting person must act on behalf and in compliance with his or her work assignation or function; the acting person committing the act must act lege artis and with adequate information about possible positive or negative effects of his or her deeds; the deed itself must be realized with intention to benefit for all society; such a deed that would harm health or life of a person must be carried out only after the person gave an consent; the deed itself must not be in conflict with other legal enactments in the state, public interest and principles of good manners and humanity; the aimed benefit of the deed must be proportional to the amount of risk undertaken. My diploma paper itself is engaged in this incorporation of permissible risk into the Czech Penal Code. After introduction, the diploma paper describes historical evolution of all circumstances excluding the illegality especially permissible risk, summarizes definitions and types of risk as such and the next subchapter deals with social aspects of risking behaviour. The main subchapter is focused on identification off all conditions of permissible risk de lege lata. Along with evaluation of the statutory form of permissible risk it mainly aims at finding out which of its general signs have been omitted by the statute and why. My diploma paper proceeds to finding ties and links between permissible risk and other circumstances excluding illegality for an act. Next part of the diploma paper is then focused on comparison of Czech and Slovak Penal Code and its provisions of permissible risk in general parts of both codes. There is a deliberation of permissible risk in the last part of my diploma paper. It is aimed to the analysis of all conditions of permissible risk de lege ferenda. In spite of the fact that permissible risk is systematically situated into the general part of the Penal Code and so can in theory be applied to all of the crimes of the special part, the nature of permissible risk rules out such a widespread application. Unfortunately, that does not minimize the importance of permissible risk, as the ?typical? crimes at which it is applicable can be expected to be quite common in such important fields of human life.
