Codes of Ethics for Public Administration - Role and Practice

Abstract:

Diplomová práce se zabývá úlohou a uplatněním etických kodexů zaměstnanců veřejné správy. V teoretické části je nejdříve přiblížen pojem etiky, veřejné správy a jejich vzájemného vztahu, dále jejich historický vývoj až po současnou právní úpravu a požadavky moderního právního státu, a to v rámci evropském a národním kontextu. Následně se diplomová práce věnuje již etickým kodexům zaměstnanců veřejné správy a jejich postavením v rámci veřejné správy, a to i jakožto nástroje v boji proti neetickému projevu chování v podobě korupce. Značná část práce je také věnována roli veřejného ochránce práv neboli ombudsmana v oblasti etiky. V poslední části práce je proveden a zhodnocen vlastní výzkum ve formě dotazníku týkající se problematiky etiky a korupce.

Abstract:

The diploma thesis deals with the role and application of codes of ethics for public administration employees. The theoretical part first introduces the concept of ethics, public administration and their relationship, then their historical development to the current legislation and the requirements of the modern rule of law, within the European and national context. Subsequently, the thesis deals with the codes of ethics of public employees and their position within the public administration, even as a tool in the fight against unethical behavior in the form of corruption. A significant part of the thesis is also devoted to the role of the Public Defender of Rights or Ombudsman in the field of ethics. In the last part of the thesis, the own research is performed and evaluated in the form of a questionnaire concerning the issues of ethics and corruption.
