Organization of management of territorially divided statutory cities

Abstract:

Hlavním cílem této práce je souhrnné poznání statutárních měst a analýza jejich členění na městské části či městské obvody. Práce se věnuje dané problematice, zkoumá opodstatnění institutu statutárních měst z hlediska teoretických poznatků. Zabývá se otázkou, zda má statut statutárního města význam nebo zda se jedná jen o otázku prestiže. Z teoretické části vyplývá, že jedinou výhodou statutárních měst oproti klasickým městům je to, že se mohou členit na městské obvody či městské části. To ale využívá jen 8 z 27 statutárních měst. V práci je analýza této problematiky vztažena na konkrétní statutární město Ostravu, které se dlouhodobě člení na městské obvody. Tyto městské obvody jednají za statutární město v záležitostech jim svěřené zákonem, avšak nemohou vydávat obecně závazné vyhlášky nebo nařízení. Je tedy paradoxní, že například obce s menším počtem obyvatel mohou přijímat vlastní nařízení a stotisícové město jako je Ostrava nikoliv. Lze tedy říci, že statutární města nejsou nějak efektivnější než města klasická. Jejich statut tak nemá moc význam a označení „statutární město“ jim dává jen jakési dobré jméno.

Abstract:

The main objective of this thesis is to provide a comprehensive understanding of the statutory cities and to analyse their subdivision into urban districts. The thesis is devoted to the issue, examines the justification of the institute of statutory cities in terms of theoretical knowledge. It addresses the question of whether the status of a statutory city is meaningful or whether it is just a question of prestige. The theoretical part shows that the only advantage of statutory cities over traditional cities is that they can be divided into districts or urban districts. However, only 8 out of 27 statutory cities make use of this. In this thesis, the analysis of this issue is related to the specific statutory city of Ostrava, which has long been divided into urban districts. These city districts act for the statutory city in matters entrusted to them by law, but cannot issue generally binding ordinances or regulations. It is therefore paradoxical that, for example, municipalities with smaller populations can adopt their own ordinances and a city of 100,000 inhabitants such as Ostrava cannot. It can therefore be said that statutory cities are somehow not more efficient than traditional cities. Thus, their status does not have much meaning and the designation "statutory city" only gives them a kind of good name.
