Collective administration of rights in the Czech Republic, their position and problematics in the music industry

Abstract:

Bakalářská práce se zabývá kolektivní správou v České republice, a to se zaměřením na hudební průmysl, ve kterém dominuje subjekt kolektivní správy Ochranný svaz autorský (OSA). Dále nastiňuje problematiku těchto správců a pomocí dotazníkového šetření zodpovídá na výzkumné otázky. Práce si klade za úkol popsat stručně vznik kolektivní správy na území ČR, dále představit jednotlivé subjekty kolektivní správy a vysvětlit principy na kterých tyto subjekty fungují. Bakalářská práce je rozdělena do dvou částí. V teoretické části práce je popsána stručná historie kolektivní správy v ČR, jsou představeny samotné subjekty kolektivní správy v ČR a jejich zakotvení v právním řádu, dále jsou uvedeny základní pojmy a kompetence, týkající se kolektivní správy, popsán systém vybíraní autorských odměn a následné přerozdělovaní těchto odměn mezi výkonné umělce a nositele práv. V teoretické části se také představí internetové platformy, které jsou v současnosti největším zdrojem konzumace hudby. Praktická část práce obsahuje kvantitativní výzkum o mínění mladých hudebníků o kolektivních správcích a jejich vztahu k takovým subjektům. Závěrečná část se následně věnuje shrnutí výzkumu a návrhům na řešení těchto problémů.

Abstract:

The aim of this bachelor thesis is to bring and summarize the collective administration of rights in the Czech Republic, with a focus on the music industry, in which the collective administration subject Protective Association of Copyright (OSA) dominates. Further outline the issues of these trustees and with help of a questionnaire investigation answer research questions. The work aims to describe briefly the emergence of collective management on the territory of the Czech Republic, to present individual collective management entities and to explain the principles on which these entities operate and to objectively define the issues concerning the management of copyright of musical works. The Bachelor thesis will be divided into two parts. In the theoretical part of the work, the reader will be acquainted with a brief history of collective management in the Czech Republic, next with the collective management bodies of the Czech Republic themselves and their enshrinement in the legal order, also the basic concepts and competencies regarding collective management, the system of collecting copyright fees and the subsequent redistribution of these fees between performers and right holders. The representation of individual collective management bodies in the Czech Republic will also be presented. Further in the theoretical section internet platforms will be introduced, which are currently the largest source of music consumption. The practical part of the work will include quantitative research on the opinion of young musicians about the administration of rights and their relationship with those subjects. The final part will then be devoted to summarization of the research and proposals of solutions to these problems.
