The Possibilities of Utilizing the Canadian Experience with Regulation of Lobbying in The European Commission

Abstract:

Magisterská práce se zabývá možnostmi využití zkušenosti kanadské federální vlády s regulací lobbingu v rámci možného budoucího řešení vztahů mezi Evropskou komisí a vnějšími zájmy. Konkrétně práce argumentuje, že některé existující předsudky Evropské komise vůči mandatorní registraci lobbistů jsou neopodstatněné, a že aplikace pravidel podobných těm v platnosti v Kanadě by mohla mít pozitivní vliv na transparentnost a representaci zájmů. Práce rovněž předkládá argumenty poukazující na skutečnost, že mandatorní registrace lobbistů za určitých podmínek nemusí znamenat překážku v přístupu k těm co rozhodují. Práce uzavírá posouzením výhod a nevýhod třech typů regulace lobbingu diskutovaných v textu a snaží se tak vymezit prostor Evropské komise pro její další rozvoj regulace lobbingu.

Abstract:

The Master’s thesis is concerned with the feasibility of utilizing the experience of the Canadian federal government with regulation of lobbying for potential future solutions to the relationship between The European Commission and external interests. In particular, the thesis argues that some existing prejudices of The European Commission against compulsory registration of lobbyists are unwarranted, and that application of rules similar to those in force in Canada could have positive effect on transparency and representation of interests. The thesis also contends that compulsory registration does not have to, under concrete circumstances, become a barrier in access to decision makers. The thesis concludes with an assessment of advantages and disadvantages of the three types of regulation of lobbying discussed in the text and, thus, attempts to delimitate the European Commission’s space for its future development of regulation of lobbying.
