Personal data protection before and after GDPR

Abstract:

Tématem této diplomové práce je ochrana osobních údajů před a po účinnosti obecného nařízení EU o ochraně osobních údajů (GDPR). Cílem práce je stručný pohled na současnou evropskou právní úpravu ochrany osobních údajů v porovnání s předchozí českou právní úpravou a pokus o hodnocení, zda GDPR poskytuje silnější právní ochranu než předchozí právní úprava. Práce je napsaná z pohledu soukromého práva a nezaměřuje se na určitou oblast. První kapitola je věnovaná pojmu soukromí a roli osobních údajů v této rovině. Druhá kapitola popisuje hlavní pojmy a zásady zpracování osobních údajů. Pro lepší přehled pojmu “souhlas” je mu věnovaná zvláštní třetí kapitola této práce. Zásadní odlišnosti mezi GDPR a předchozí právní úpravou jsou řešeny v kapitole čtvrté, zde je zároveň prozkoumáno, zda poskytuje GDPR lepší ochranu osobních údajů. Součástí mé práce je také příloha, která je tvořena ukázkou toho, jak by mohly vypadat Zásady ochrany osobních údajů na příkladu návrhu Zásad ochrany osobních údajů pro e-shop s chovatelskymi potřebami.

Abstract:

The topic of this thesis is personal data protection before and after GDPR (General data protection regulation). The main objective of this work is to analyse whether really provides better protection of personal data than previous legislation. The work is written from the perspective of private law and doesn’t focus on any specific area. First chapter of this work is dedicated to the concept of privacy and to what role the personal data plays in this area. The second chapter describes main concepts and main principles of personal data processing. For the better understanding of the concept of agreement, the third chapter of this paper analyses whether person’s agreement is the main legal base of personal data processing or not. Fundamental differences between GDPR and previous legislation of personal data protection are demonstrated in the fourth chapter, which contains investigation whether GDPR really provides better personal data protection. An attachment can be found at the end of my diploma thesis and it contains proposal of the Privacy Policy of the e-shop for pet supplies as an example of how the Privacy Policy could look like in practise.
