Waterworkson Lands of another with a Focus on Lands Owned by the State

Abstract:

Tato bakalářská práce se zabývá problematikou právních vztahů k vodním dílům na cizích pozemcích, a to s důrazem na vodní díla vybudovaná v korytě vodního toku na pozemcích ve vlastnictví státu, k nimž mají právo hospodařit Povodí a která byla na těchto pozemcích umístěna před 1. lednem 2002. Po vymezení historickoprávních souvislostí, pojmu vodního díla a způsobu nakládání s majetkem ve vlastnictví státu se zaměřuje na způsoby řešení vzájemných právních vztahů vlastníků vodních děl a Povodí jako státních podniků s právem hospodařit k pozemkům ve vlastnictví státu. V následujících částech je prostor věnován smlouvě o zřízení služebnosti a problémům souvisejících s její přípravou. Před závěrem práce je část věnována pokusu o analýzu dopadu superficiální zásady na právní režim vodních děl. Závěrečná část práce shrnuje poznatky, ke kterým bylo dospěno při vypracovávání práce a studiu odborných materiálů.

Abstract:

This thesis deals with the legal relationship to the water works constructions on foreign land with an emphasis on waterworks constructions built in the bed of a watercourse on land owned by the state for which they have the right to manage Povodí company (= Catchment area) which were placed on these lands before January 1, 2002. After defining historical and legal context the concept of water works and manner of use of property owned by the state the thesis focuses on ways to address mutual legal relations owners of waterworks and Povodí company as state-owned enterprises with the right to manage the land in state ownership. The following parts are devoted to the treaty about the establishment of the easement and the problems associated with its preparation. Before the conclusion of the work there is a part to devote to trying to analyze the effects of superficial principles of the legal régime of waterworks. The final part summarizes the findings which have been developing from the work and the study of special materials.
