Trademarks the introduction of the product on the market

Abstract:

Diplomová práce je zaměřena na problematiku ochranných známek a jejich právní úpravu. Začátek je věnován historickému vývoji ochranných známek, vymezení pojmu ochranná známka, jejich významu a funkcím. Dále se zabývá klasifikací ochranných známek a označeními vyloučených ze zápisu. Značná část práce se věnuje postupu při registraci ochranné známky, době jejich platnosti, zániku práva k ochranné známce a právům a povinnostem vlastníka. V práci nechybí ani část zaměřující se na ochranné známky Evropské unie a Mezinárodní ochranné známky.

Abstract:

This diplom thesis focus on thema trademark and legislation dealing with them. Beggining of this thesis is about historical development of trademarks, definitions, as well as functions and meanings of trademarks.Later, this work also describes classification of trademarks and signs excluded from the list. Significant part of this work also describes procedures in terms of registrations, validity of registration, also determines when the right of the owner for the trademark is not valid anymore and last but not least rights and obligations of the owner of trademark. We can also find part dedicated to trademarks belonging to European Union and International trademarks.
