Unfair competition in the Czech Republic

Abstract:

Bakalářská práce se zabývá nekalou soutěží na území České republiky. Jsou zde popsány jednotlivé nekalosoutěžní delikty a způsoby, jakými je možné se proti nim bránit. Tyto způsoby jsou rozčleněny dle kategorie, do které spadají (soukromoprávní, veřejnoprávní, mimoprávní prostředky) a dle aktivně legitimovaných osob, jimž jsou přiřazeny jednotlivé prostředky ochrany proti nekalé soutěži, včetně promlčení. Práce zahrnuje i procesní specifika ve věcech nekalé soutěže. Bakalářská práce se věnuje i problematice pojmenovaných a nepojmenovaných skutkových podstat nekalé soutěže. Tato bakalářská práce obsahuje rovněž vysvětlení pojmu soutěžního práva a nastínění prostředků ochrany proti omezování hospodářské soutěže, roli Úřadu na ochranu hospodářské soutěže a další základní pojmy (soutěžitel, relevantní trh atd.). Poslední kapitola se zabývá nekalou soutěží v rámci legislativy Evropské unie, neboť i předpisy EU zasahují do české legislativy. Bakalářská práce obsahuje rovněž pohled na historický vývoj nekalé soutěže v českých zemích. K vypracování této bakalářské práce bylo využito studium širokého spektra dokumentů, vlastní interpretace a komparativní metoda, jež byla využita pro porovnání právní úpravy nekalé soutěže v obchodním zákoníku (dále i v občanském zákoníku) a v novém občanském zákoníku.

Abstract:

The bachelor’s thesis deals with unfair competition in the Czech Republic. In this thesis are written particular wrongs in unfair competition and ways how it is possible to protect against them. These ways of protection are divided to categories where they belongs to (based on the private law, public law or extra-legal) and according to actively legitimate persons which have particular ways of protection against unfair competition, including the lapse of time. This thesis includes procedural specific in cases of unfair competition. This bachelor’s thesis deals with the issue named and unnamed factual merits of unfair competition. The thesis includes definition of the competitive law and outlines ways of protection against restrictions on the economic competition, the role of Office for the protection of competition and the next basic terms (a competitor, a relevant market, etc.). The last part of thesis deals with unfair competition in the acquis communautaire because regulations of EU affects to the Czech legislation too. The bachelor’s thesis contains view to historical development of unfair competition in the Czech countries. To working out this thesis were used study of wide spectrum of documents, my own interpretation and the comparative method. This method was used especially to compare legislation in the commercial code (and the next in the civil code) and in the new civil code.
