Principle "ne bis in idem" in criminal proceedings

Abstract:

Diplomová práce se zabývá zásadou ne bis in idem v trestním řízení, hlavně s pohledu judikatury Evropského soudu pro lidská práva. Cílem práce je rozebrat zásadu na jednotlivé prvku a ty za pomocí analýzy judikatury co nejpřesněji definovat. Diplomová práce seznamuje čtenáře s pojmem zásady a její stručnou historii. Poté rozebírá pojem „trestní řízení“, „duplikace řízení“, „konečné rozhodnutí“ a v neposlední řádě „stejná fakta“, to vše s pohledu Evropského soudu pro lidská práva v rámci článku 4 protokolu 7 Úmluvy o ochraně lidských práv a základních svobod.

Abstract:

The diploma thesis deals with the principle of ne bis in idem in criminal proceedings, mainly from the point of view of the jurisprudence of the European Court of Human Rights. The purpose of the thesis is to break down the principle into individual elements and define them as precisely as possible with the help of case law analysis. The diploma thesis introduces the reader to the concept of principle and its brief history. He then analyzes the concept of "criminal proceedings", "duplication of proceedings", "final decision" and, last but not least, "same facts", all from the point of view of the European Court of Human Rights within the framework of Article 4 of Protocol 7 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
