Protection of the Weaker Parties in the Light of the New Civil Code

Abstract:

Téma ochrany slabší smluvní strany zažívá v posledních několika desítkách let prudký vývoj. Cílem diplomové práce je poukázat na některé aspekty této ochrany v novém občanském zákoníku. V obecné části práce autor vymezuje základní zásady smluvního práva, které se bezprostředně dotýkají ochrany slabší smluvní strany. To má význam zejména v souvislosti s iusnaturalistickým základem nového občanského zákoníku. Ve zvláštní části práce jsou analyzovány tři, podle názoru autora, významné instituty dotýkající se ochrany slabší smluvní strany v novém občanském zákoníku. Těmito konkrétními instituty jsou lichva, neúměrné zkrácení (laesio enormis) a zvláštní ustanovení o prodeji zboží v obchodě.

Abstract:

In the few last decades, the issue of weaker parties protection passed through a rapid development. The aim of this work is to highlight some aspects of this protection in the new Civil Code. In the general part, the author defines the basic principles of the contract law that directly affect the protection of the weaker’s party. In particular, he empasizes the importance of the relation with natural law basis of the new Civil Code. In a separate part of this work, three of the important institutions concerning the weaker parties‘ protection in the new Civil Code, are discussed. Specifically, the specific usury, an excessive shortening (laesio enormis) and the special provisions for the sale of goods in the store are analyzed.
