Ban of Political Parties in Selected Democratic States since 1945

Abstract:

V této bakalářské práci se zabývám problematikou zákazů činnosti tzv. antisystémových politických stran a hnutí v České republice a vybraných demokratických státech. V teoretické části práce se věnuji vymezení základních pojmů (politická strana, antisystémová strana, extremismus, radikalismus aj.) a typologii antisystémových stran a hnutí. V praktické části práce se zaměřuji na rozbor konkrétních příkladů politických stran a hnutí, které čelily odmítnutí návrhů na jejich registraci nebo rozhodnutí o jejich rozpuštění. Protože rozpuštění politické strany pokládám za krajní prostředek, zabývám se ve své práci i dalšími možnostmi boje s politickým extremismem v demokratických státech v podobě prevence, izolace a represe v mírnějších podobách než je rozpuštění strany či hnutí. V závěrečné části se pokouším zhodnotit efektivitu a legitimitu zákazů politických stran a hnutí v České republice a ve vybraných státech s přihlédnutím k aktuální politické situaci.

Abstract:

In this Bachelor's thesis I deal with the issue of ban of antisystemic political parties´s and movements´s activities in the Czech Republic as well as other selected democratic states. The theoretical part of the thesis is concerned with the definition of basic concepts (political party, the antisystemic party, extremism, radicalism, etc..) and the typology of antisystemic parties and movements. In the practical part of the thesis I focus on the analysis of specific examples of political parties and movements, which faced the rejection of proposals for their registration or the decision on their dissolution. Since I consider the dissolution of political parties the last resort, I deal with additional options of fight against political extremism in democratic states in the form of prevention, isolation and repression in more moderate ways than the dissolution of the party or movement is. In the final part I have tried to assess the effectiveness and legitimacy of bans on political parties and movements in the Czech Republic and in selected states taking into consideration the current political situation.
