Legitimate Expectation in Civil Law

Abstract:

Ochrana občanských práv je spjata s legitimním očekáváním fyzických a právnických osob, majícím relevanci ve vztahu k soudu jako ukazatel spravedlivého a rozumného řešení právního případu. Legitimní očekávání je principem odvozeným od právní jistoty a důvěry v právo. Není spojeno pouze s nezbytnou předvídatelností soudního rozhodování, avšak působí i jako nástroj soudcovského výkladu a dotváření práva. Jedná se o princip, kterým civilní soudy argumentují v rámci interpretace a aplikace práva, aby dosáhly spravedlivého rozhodnutí ve složitých případech.

Abstract:

The protection of civil rights is connected with the legitimate expectation of individuals and legal persons that has the relevance for the court as the indicator of fair and reasonable solution of the case. The legitimate expectation is the principle which is derived from the legal certainty and confidence in the law. It is not related only with the necessary predictability of the judicial decisions, but its importance is also in being as the instrument of judicial development of law (the judge-made law). The civil courts must this principle take into account when interpreting and applying the law, in order to reach the justiciable decision in the hard cases.
