Duties of Real Estate Broker as a Member of a Regulated Profession

Abstract:

Práce předkládá systematické uspořádání povinností realitního zprostředkovatele, tedy od splnění základních povinností před vstupem na trh (spojené se získáním živnostenského oprávnění a doložením povinného pojištění), přes povinnosti při výkonu této profese, až k nepřímým povinnostem realitního zprostředkovatele, bez jejichž aplikace nelze poskytovat služby řádně a s odbornou péčí. V závěrečné fázi je přistoupeno k řešení výzkumné otázky, zda může, případně v jakém rozsahu, realitní zprostředkovatel připravovat realitní smlouvy, aniž by překročil rozsah živnostenského oprávnění nebo se dostal do rozporu s podmínkami poskytování právních služeb. V této otázce panují výkladové nejasnosti a odborná veřejnost je rozdělena na dvě názorové linie, proto není možné na výzkumnou otázku nalézt jednoznačnou odpověď, aniž by byly vyřešeny výkladové nejasnosti. V práci je tak navrženo řešení právního rámce změnou zákona tak, aby odpověď na tuto otázku byla postavena najisto. Předmětem dalšího zkoumání by mohlo být porovnání právního rámce převodu nemovitostí v okolních evropských zemích, tedy kdo a za jakých podmínek je oprávněn zajistit převodní smlouvy a převod nemovitostí a řešení výzkumné otázky, zda by nebylo vhodnější, aby převody zajišťoval výhradně notář (jako např. ve Francii) přímým zápisem do katastru nemovitostí; zvážit přitom přínosy např. bezpečnost převodu a negativa takového opatření ve formě např. vyšší časové náročnosti celého procesu.

Abstract:

The thesis presents a systematic structure of the duties of a real estate agent, from the fulfilment of basic duties before entering the market (related to obtaining a trade license and proof of obligatory insurance), through the duties in the exercise of this profession, to the indirect duties of a real estate agent, without the application of which the services cannot be provided properly and with professional care. In the final step, the research question is solved as to whether, or to what extent, a real estate intermediary can prepare real estate contracts without exceeding the scope of the trade licence or coming into conflict with the conditions for the provision of legal services. There are interpretative uncertainties on this question and the professional community is divided into two lines of opinion, therefore it is not possible to find an explicit answer to the research question without resolving the interpretative uncertainties. The thesis proposes a solution to the legal framework by amending the law so that the answer to this question is made certain. The subject of further research could be a comparison of the legal framework for the transfer of real estate in neighbouring European countries, i.e. who and under what conditions is entitled to ensure the transfer agreements and the transfer of real estate and to solve the research question whether it would not be more appropriate for transfers to be ensured exclusively by a notary (as e.g. in France) by direct registration in the land register; to consider the benefits, e.g. the security of the transfer and the negatives of such a measure in the form of e.g. increased time-consuming nature of the whole process.
