Planning of Investigation in Criminalistic Practice

Abstract:

Tato bakalářská práce je zpracovaná na téma plánování vyšetřování v kriminalistické praxi. Cílem této práce je shrnout podstatu vyšetřování z pohledu trestního práva a z pohledu kriminalistiky. Cílem je rovněž proces plánování vyšetřování a úlohu vyšetřovacího plánu tak, aby mohl každý policista, nejen zařazený u služby kriminální policie a vyšetřování, ale i zařazený na běžném obvodním oddělení, pochopit smysl plánování vyšetřování a jeho nezastupitelnou úlohu při objasňování trestné činnosti. Práce se skládá z popisu vyšetřování podle pohledu trestního práva, z popisu vyšetřování z pohledu kriminalistiky a z popisu systematizace Policie České republiky ve vztahu k vyšetřování. Podrobně je rozveden obsah, forma a význam plánu vyšetřování, smysl a význam plánování jako kriminalistické činnosti. Poslední část práce je zaměřena na metodiku vyšetřování konkrétního trestního činu – Vraždy. Metodika vyšetřování vraždy je dle mého názoru nejvíce vhodná pro účely popsání důležitosti plánování, jelikož se jedná o nejzávažnější trestný čin, o kterém trestní právo pojednává. Jeho vyšetřování zpravidla doprovází v první řadě sestavení vyšetřovacího týmu, jehož vedoucí musí řídit celý proces vyšetřování. K tomu mu nezastupitelně slouží právě plán vyšetřování. Výsledkem práce je dle zmíněných cílů, zpracovaný výtah informací z trestního práva ve vztahu k vyšetřování, výtah informací z kriminologické vědy a především z kriminalistických praxí, tak aby i laik pochopil smysl vyšetřování, smysl plánování a veškeré propojení s metodikou vyšetřování daného trestného činu. Mělo by být jasné, že plánování není jen stereotypní činností, ale že každý případ má svůj individuální plán a způsob vyšetřování. Tato práce je určena především pro policisty zařazené na obvodních odděleních, aby si vytvořili představu o tom, co následuje ve vyšetřování, jak mají správně zpracovat plán, a že jeho podstata je velmi důležitá.

Abstract:

This bachelor theses focuses on the Planning of Investigation in Criminalistic Practice. The objective of this work is to put together the essence of investigation from the perspective of criminal law and Criminalistics. Other objective is the process of planning investigation itself and the role of the investigating plan so that every policeman in police criminal service or in the basic police district department is able to understand the importace of planning investigation and its irreplaceable part in clarification of a crime. The thesis consist of introducing investigations according to the criminal law and according to the criminalistcs and of description of systematical investigation applied by Czech Republic Police. The plan of investigation, its subject, form and importance and also the importance of the planning as a criminalistic activity is specified in detalis in this work. The last part of the work is focusing on the methodics of investigating particular crime - murder. In my opinion this methodics is suitable the most for taking up the importance of planning the investigation and it is also because murder is the most serious crime that criminal law deal with. With investigating serious crimes it goes along completing the investigation team with its own team leader and now there is the important part of the investigation plan. The result of this work is, according to the mentioned objectives, abstract of criminal law in relation to the investigation, abstract of information from forensic science and practice in the way so everyone uninitiated could understand the fundamentals of investigation and planning and all the connection with methodics of investigating of a crime. It shoud be clear that planning is not just stereotypical activity so that every case itself has its own individual plan and process of investigation. Thesis is above all assigned to all policemen in police district departments so that they could create an idea what investigation consists of, how to properly make a plan and that its essence is relevant.
