Role of the Final Recourse in the System of Legal Remedies
Abstract:
Diplomová práce se zabývá rolí dovolání v systému opravných prostředků v rámci civilního řízení, přičemž vychází z obecného vymezení účelu opravných prostředků, z komparace různých modelů dovolání a rovněž z historického vývoje institutu na našem území. Dále se snaží posoudit míru naplnění vymezené role. Syntéza uvedených poznatků je podkladem pro návrh úpravy de lege ferenda.
Abstract:
The thesis focuses on the role of the final recourse in the system of legal remedies in civil litigation. It is based on the definition of the general purpose of legal remedies, on the comparison of different models of final recourse in foreign countries and also on the historical development of the institute in the Czech Republic.
