Alternative dispute resolution for consumers in the Czech Republic and Australia

Abstract:

Tato práce se bude zabývat ochranou spotřebitele v České republice a v Austrálii, jelikož ochrana spotřebitele představuje rozsáhlé téma, zaměřím se na mimosoudní řešení sporů v těchto zemích. Cílem bakalářské práce bude na základě teoretických znalostí, analýzy a komparace systémů mimosoudních řešení spotřebitelských sporů v České Republice a v Austrálii zhodnotit jejich stav. Práce bude rozdělena do dvou kapitol. První kapitola se zaměřuje na základní pojmy ochrany spotřebitele a na existující způsoby mimosoudních řešení sporů, druhá kapitola se věnuje právní úpravě, pravidlům pro postupy řešení, jejich formám a orgánům v ČR a Austrálii, jelikož je Austrálie federativní stát, zaměřím se především na federální úroveň a dále na jeden stát z celé konfederace Nový Jižní Wales. Nakonec kapitoly bude následovat srovnání obou zemí.

Abstract:

This bachelor thesis will deal with consumer protection in the Czech Republic and Australia, as consumer protection is a broad topic, I will be focusing on alternative dispute resolution for consumers in mentioned countries. The aim of the bachelor's thesis will be to evaluate their state on the basis of theoretical knowledge, analysis and comparison of systems of alternative dispute resolution in the Czech Republic and Australia. The thesis will be divided into two chapters. The first chapter will focuse on basic concepts of consumer protection and on existing ways of out-of-court settlement of disputes, the second chapter will deal with legal regulations, rules for procedures, their forms and authorities in the Czech Republic and Australia, since Australia is a federal state, I will focus mainly on the federal level and further on one state from the confederation specifically New South Wales. Finally, the chapters will be followed by a comparison of the two countries.
