Local Referendum in the Czech Republic from the Theoretical and Empirical Point of View

Anotace:

Rigorózní práce Místní referendum v České republice z teoretického a empirického hlediska pojednává o nejrozšířenější a nejdůležitější formě přímé demokracie v České republice - místním referendu. Spis je členěn do tří částí: obecné zvláštní a statistické. Obecná část obsahuje čtyři kapitoly. Kapitola první má poskytnout vstupní informace o nadřazeném pojmu problematiky místního referenda, a sice o přímé demokracii. Nebylo záměrem autora podat zevrubné pojednání o teorii demokracie, přesto nebylo možno tuto kapitolu, byť je zařazena ve skromnějším rozsahu, opomenout, má-li text plynout přirozeně a souvisle, od obecného k specifickému. Druhá kapitola pojednává o institutu referenda z teoretického hlediska. Zabývá se klasifikací referend a jejich typologií. S rostoucí oblíbeností referenda v posledních desetiletích souvisí i stoupající počet prací, které reagují na danou problematiku a studují referendum jako obecný institut. Třetí kapitola obsahuje ústavní a mezinárodní východiska místního referenda, čtvrtá je exkurzem do vývoje právní úpravy sledovaného institutu. Zvláštní část se věnuje místnímu referendu de lege lata. V celkovém pořadí pátá kapitola se zabývá teritoriální, personální a časovou stránkou místního referenda, šestá pojednává o jeho předmětu (pozitivní a negativní definici), sedmá se týká procesu jeho vyhlašování. K vyhlášení místního referenda vedou dvě cesty. Za prvé je možno vyhlásit místní referendum čistě z politické vůle zastupitelstva, za druhé zastupitelstvo vyhlašuje referendum na návrh přípravného výboru po podpisové akci. Předmětem osmé kapitoly jsou orgány zajišťující průběh hlasování, jimiž jsou v případě místního referenda komise. Pasáže, které se jim věnují, jsou charakteristické zvýšenou mírou popisnosti, která však byla po mém názoru nutná, aby byl zachován skutečně komplexní náhled na danou tematiku. Devátá kapitola přibližuje fáze hlasovacího procesu a jim předcházející kampaň. Na hlasování bezprostředně navazuje zjišťování a vyhlašování jeho výsledků, které je tématem desáté kapitoly. Kapitola jedenáctá se věnuje nejzávažnějším důsledkům, které z hlasování vyplývají. Jsou jimi platnost a závaznost rozhodnutí místního referenda, jeho náklady a oznamovací povinnost. Dvanáctá kapitola pak pojednává o prostředcích soudní kontroly místního referenda a třináctá o přestupcích a trestných činech souvisejících s místním referendem. Statistická část pak obsahuje úplný přehled výsledků místních referend konaných za uplynulých 30 měsíců.

The rigorous work Local referendum in the Czech Republic from the theoretical and empirical point of view deals with the topic of both the most widespread and the most important form of direct democracy in the Czech Republic – local referendum. Its composition is divided into three parts: the General one, the Specific one and finally the Statistic one. On General Part The principal intention of the General Part is to provide the entry to the topic. Wherever direct democracy exists, it has not replaced representative democracy but has complemented the work of elected body and political parties. Clear direct democracy is dangerous and undesirable. Nevertheless it is obvious that instruments of direct democracy are important elements of the democratic supervision. Principal method of direct democracy is a referendum. It is a direct vote in which an entire electorate is asked to either accept or reject a particular proposal. Development of the legal regulations and constitutional foundations of local self-government and direct democracy are discussed in chapters of this part as well. On Specific Part This section is concerned with legal and empirical questions of the local referendum in the Czech Republic. Czech law permits referendums only at the level of communes, not at the level of regions. Relevant is Act No. 22/2004 Coll., on Local Referendum that became effective on February 1, 2004 and replaced previous codification. Local referendum is held on local issues related to the conduct of policy in a municipality. The right to vote is reserved for citizens aged 18 or older, whose permanent place of residence is in the community, where the referendum is held. EU-citizens are also allowed to take part. Issues, such as the municipal budget, local duties, election and recall of the mayor and other members of local elected body, issues treated by special processes, structure of the municipal office, contracts governed by public law, municipal ordinances and issues which were subjected to a referendum during the preceding two years cannot be addressed by referendum. It is also not permitted to hold a local referendum concerning the splitting of the commune, if it results in the establishment of a commune that has less than 1000 inhabitants (see Act No. 128/2000 Coll., on Communities). There are two ways how to hold local referendum in the Czech Republic – from bellow and from above. Firstly, local referendum can be compelled if the required number of signatures (depended on the number of inhabitants of the municipality) is collected by so called preparatory committee. Secondly, local board by itself can initiate local referendum if absolute majority of all its members decides so. Entitled persons have to go to the polls and present their identity card, which is checked against the data available on the list of the voters made by special law. The process of the ballot is guaranteed by a district commission which is composed of a chairman, vice-chairman, secretary and other members. The decision of the referendum is valid if, at least, one half of the persons with right to vote cast a ballot. The result of the referendum is binding on local authorities. The high turnout quorum means that local referendums are often declared invalid, which indeed tends to weaken motivation of citizens to participate in political life of the municipality. In the event that problems should arise, judicial review of local referendum is guaranteed by Act No. 150/2002 Coll., the Code of Administrative Justice. In matters of local referendum, administrative courts are competent to hear disputes relating to correctness of the proposal to hold local referendum, validity of ballot, validity of the decision accepted in local referendum and electoral register (or more precisely register of entitled persons). ech Republic during last thirty months. In this period, almost 50 local referendums were recorded by the author in the Czech Republic. These referendums were held especially on issues of planning (e. g. Brno, Dolní Kounice, Světlá Hora), waste management (see Opatovice, Čeperka), disposal of municipal property (e. g. Brušperk, Český Těšín, Miroslav), environmental care (e. g. Bohušovice nad Ohří, Horní Jiřetín), wind power plants (e. g. Boží Dar), education (e. g. Letohrad, Dasnice), splitting of communes (Držovice), amalgamation of communes (Hostovice) etc.
