The Fight against Terrorism and its Criminal Aspects

Abstract:

Předmětem této bakalářské práce jsou některé aspekty boje proti terorismu. Úvodní kapitoly práce směřují k pojmovému vymezení terorismu, dále jeho historickým konturám, podávají přehled o obecné typologii terorismu a věnují se jeho metodám. Zde jsou využity poznatky z prací předních českých odborníků na terorismus. Pojednání o aktérech terorismu – tedy teroristech a jejich skupinách se orientuje zejména na jejich vymezení z pohledu platného evropského práva. Další kapitoly této práce se věnují aspektům boje proti terorismu, zejména aspektům právním. Strukturovány jsou tak, aby podaly přehled nejprve o mezinárodně právních východiscích a mezinárodních nástrojích Světového společenství v boji proti terorismu, zejména Organizace spojených národů a jejích orgánů, dále Rady Evropy a Organizace pro bezpečnost a spolupráci v Evropě. Výklad se věnuje zejména mezinárodním úmluvám a je v poznámkovém aparátu doplněn jejich výčtem. Postupně přechází k výkladu o evropských východiscích boje proti terorismu a právních nástrojích Evropské unie – Europolu, Eurojustu, Evropském zatýkacím rozkazu, společných vyšetřovacích týmech a řadě dalších opatřeních v právní oblasti. V rámci těchto kapitol jsem se snažil také poukázat na některé rozdíly v pojetí právní úpravy boje proti terorismu v kontinentálním a anglosaském právu, přičemž důraz kladu na kontext s dodržováním základních lidských práv. Více než třetina bakalářské práce, která tvoří její závěr, je věnována českým národním aspektům boje proti terorismu. Zde se nejprve věnuji historii terorismu v českých zemích, jeho podpoře v době, kdy bylo Československo součástí socialistického bloku i jeho projevům v době od roku 1989, kdy země opět nastoupila demokratickou cestu. V další kapitole se věnuji národním nástrojům boje proti terorismu, které se snažím zpřehlednit rozdělením na nástroje politické, institucionální a právní. Pojednání o institucionálních nástrojích, tedy orgánech, které se boje účastní či mohou účastnit, podává i přehled o jejich právním základě. Národní právní nástroje jsou pak v mé práci zastoupeny zejména rozborem, k pojmu terorismu signifikantních, trestných činů teroristického činu a teroru a to jak v kodifikaci v současné době platného a účinného zákona č. 140/1960 Sb. Trestní zákon, tak i nové právní úpravě českého trestního práva hmotného – platného a od 1.1.2010 účinného zákona č. 40/2009 Sb. Trestní zákoník. Zde jsou obsaženy jak rozbory skutkových podstat těchto trestných činů, tak i rozdíly mezi úpravou stávající a budoucí. V závěru kapitoly o národních aspektech boje proti terorismu se věnuji spolupráci českých orgánů v oblasti policejní a justiční – tedy zastoupení České republiky v Europolu a Eurojustu. V samotném závěru práce hodnotím dosažené výsledky. Práci jsem doplnil o některé přílohy, které v případě zájmu mohou rozšířit výklady v textu práce. Nechybí seznam zkratek v práci použitých a seznam literatury a dalších pramenů z nichž jsem čerpal. Snažil jsem se čerpat z co možná nejaktuálnější prací předních českých odborníků na otázky terorismu

Abstract:

The subject of this Bachelor's thesis are several aspects of the fight against terrorism. Initial chapters include the definition of terms related to terrorism, its historical context, a general typology of terrorism and its methods. Findings of leading Czech experts on terrorism are the main source of these chapters. A treatment of the terrorism's manpower – i.e. terrorists and their groups focuses mainly on their definition within the current European legislation. Further chapters are dedicated to aspects of the fight against the terrorism, mainly the legal point of view. As a predominant topic, the structure of the thesis reflects the international legal solutions and tools used in fighting terrorism, especially those of the United Nations and its authorities, the European Council and the Organization for Security and Cooperation in Europe. The thesis concentrates mainly on international treaties and is complemented with their list as a part of the appendix. Also described are Europe's legal solutions in the fight against terror and European Union's legal tools – Europol, Eurojust, the European Arrest Warrant, joint investigation teams and many other legal measures. Here, I tried to point out several differences in the legal treatment of the fight against terrorism between Continental and Anglo-Saxon law, focusing especially on their context with human rights observance. More than a third of the Bachelor's thesis, forming also its conclusion, is dedicated to Czech national aspects of the fight against terrorism. Firstly, the Czech fight against terror is discussed, as well as its support during the Czechoslovakia's involvement in the Socialist block, and its history since 1989, when the country returned to democracy. In the next chapter I described the tools taken against terror in the Czech Republic, attempting to find a structure within their scope to political, institutional and legal tools. Institutional tools, or authorities directly involved in the fight or possible fight against terrorism, are treated including a summary of their legal background. Legal tools are reflected in an analysis of crimes of terror as an important part of terrorism's definition, from the viewpoint of their current background within the currently valid Law No. 140/1960 Coll., Criminal Code, as well as its position in the newly amended Czech criminal legislation pertaining to damage to property – Law No. 40/2009 Coll., Criminal Code, valid and in force as of 1st January 2010. Here, analysis of the facts of the criminal cases as well as of the differences between the current and future related legislation. As a part of the chapter's conclusion, I discussed the cooperation of Czech police and court authorities – i.e. the representation of the Czech Republic in Europol and Eurojust. The actual conclusion evaluates results achieved. The thesis is complemented with appendices, which can assist in elaborating on the subject discussed further in case of interest. Also included is a list of abbreviations used in the text as well as a list of literary and other sources which I used. I used the most up-to-date treatments of leading Czech experts on terrorism available.
