Abstract:

Tato bakalářská práce analyzuje faktory ovlivňující komunikaci v trestním řízení s porotou a poukazuje na nezbytnost přizpůsobit komunikaci těmto faktorům za účelem úspěchu v řízení. Přístupem pragmatiky se analýza zaměřuje na jednotlivé účastníky řízení a jejich role a dále na kontext, který určuje jejich jazykové volby. V první kapitole je představeno téma bakalářské práce, formulována hlavní myšlenka a cíl práce a dále jsou zde představeny materiály, na nichž je analýza založena. Ve druhé kapitole se zabývám specifiky komunikace v soudní síni a typickými znaky této komunikace, jako je její fragmentace a neustálá snaha o narativní prezentaci činu nebo používání právnického jazyka a simultánní snaha o srozumitelnost pro laickou porotu. Třetí kapitola podává základní informace o procesu s O. J. Simpson, jenž je základem analýzy. Dále zde poukazuji na specifika řízení s porotou a na hlavní rozdíl mezi civilním a trestním řízením: důkazní břemeno, u něhož poukazuji na jeho význam pro volbu komunikační strategie v řízení. Ve čtvrté kapitole představuji přehled hlavních faktorů, které ovlivňují interakci mezi účastníky řízení a jejich komunikaci. Je zde provedena jejich základní klasifikace na objektivní a subjektivní faktory, and naznačen jejich vliv na komunikaci v řízení a volbu strategie. Pátá kapitola tvoří jádro analýzy a v jejích osmi podkapitolách se zaměřuji na jednotlivé účastníky řízení: soudce, porotu, soudního zapisovatele, právní zástupce stran, svědky, obžalovaného, oběť a média. Ve vztahu ke každému z těchto účastníků řízení analyzuji hlavní znaky jejich dané role v řízení a vliv těchto znaků na jejich účast v komunikaci v rámci procesu. Rovněž se zde zabývám typickou komunikační interakcí mezi jednotlivými účastníky řízení. Analýza je demonstrována na příkladech z protokolu z procesu O. J. Simpson. Bakalářskou práci uzavírá závěr v šesté kapitole, v níž shrnuji své poznatky a prezentuji závěr, že pro úspěch v trestním řízení s porotou je nezbytné přizpůsobit komunikaci kontextuálním faktorům. V tomto typu řízení je základním principem téměř veškeré komunikace srozumitelnost a přesvědčivost komunikace pro porotu, neboť porota je faktorem určujícím komunikační strategii právních zástupců stran.

Abstract:

The thesis analyses factors influencing discourse in a criminal trial by jury, and points at the importance of adaptation of the discourse to these factors in order to succeed in a trial. By the approach of pragmatics, the analysis focuses on the individual participants and their roles in the trial, and the context, which determines their discourse choices. In the first chapter, I have introduced the thesis topic, formulated the main thesis and the aim of the thesis, and introduced the materials on which the analysis is based. The second chapter deals with specifics of a discourse taking place in the environment of a courtroom, and the typical features of such discourse, such as its fragmentation and the constant struggle for narration of the crime story; or the use of legal register and simultaneous attempt to be comprehensible to the lay jury. In the third chapter, basic information on the trial of O. J. Simpson, which forms the basis for the analysis, is given; the specifics of the jury trial are pointed out; and the main distinction between the civil and criminal trial: the burden of proof, is introduced together with its significance for the choice of discourse strategy in a trial. The fourth chapter presents an overview of the main factors determining interaction between trial participants and their discourse, their basic categorisation into objective and subjective factors; and their importance for the discourse in a trial and the choice of strategy. The fifth chapter is the core of the analysis and in eight subchapters it focuses on the individual trial participants: judge, jury, court reporter, counsels, witnesses, defendant, victim and media. With respect to each of these participants, I analyse the main features of their particular role in the trial and the effect of these features on their participation in the trial discourse. The typical communication interaction between the respective participants is also discussed. The analysis is demonstrated on examples taken from the transcript of the O. J. Simpson trial. The thesis concludes in chapter six where I summarise my findings, and come to the conclusion that adapting the discourse to the contextual factors is the key for success in a trial. In a criminal trial by jury, the comprehension and persuasion of the jury is the underlying principle for nearly all discourse that is taking place in the courtroom since the jury is the driving force behind the counsels’ discourse strategy.
