Disinheritance of Forced Heir

Abstract:

Práce se stručně zabývá postavením nepominutelného dědice, přičemž hlavní část práce je věnována institutu vydědění nepominutelného dědice a s tím spojeným výkladovým problémům. Celá materie je pojata s ohledem na nedávnou rekodifikaci občanského práva, kterou bylo postavení nepominutelného dědice vráceno do jeho historické podoby, když v souvislosti s tímto doznal značných změn i institut vydědění. Z tohoto důvodu nejsou v práci opomenuty ani inspirační zdroje současné úpravy. Práce je pak zakončena novelou rakouského dědického práva, která ukazuje, jakým směrem se náš hlavní inspirační zdroj posunul.

Abstract:

The thesis briefly discusses the status of forced heir, while the main part of the theses deals with the institute disinheritance and the associated interpretation problems. The whole matter is conceived in light of the recent recodification of civil law, which has returned the conception of a forced heir to its historical form, when the institute disinheritance has also changed considerably. Therefore, the work does not ignore the sources of inspiration for current regulation. The work is finished by the Amendment of Succession law in Austria, which shows the direction in which our main source of inspiration shifted.
